CONSEQUENCES OF POSITIVE TEST RESULTS. For post-Accident or reasonable suspicion, a Covered Employee shall be immediately removed from performing his or her job or, in the alternative, may be temporarily reassigned to work that is not safety-sensitive if such work is available. The Covered Employee shall be subject to disciplinary action, and shall meet with the SAPC, as set forth in Exhibit A, and section 10 below, if the Covered Employee:

CONSEQUENCES OF POSITIVE TEST RESULTS. 1. An employee who tests positive shall have the right to challenge the accuracy of the test results before any disciplinary procedures are invoked as specified in Section (E) (7) and the Departmental Grievance Procedure.
CONSEQUENCES OF POSITIVE TEST RESULTS a. An employee who tests positive for alcohol or controlled substances may be disciplined as described in Article 30. Any recent unintentional exposure reports (see 35.1.b.3) will be taken into consideration.

An employee who has tested positive for the presence of intoxicants or controlled substances pursuant to this Appendix shall be referred to the Employee Assistance Program or drug or alcohol counseling. An employee's participation in the Employee Assistance Program or in drug or alcohol counseling will be considered in determining what, if any, disciplinary action may be taken.
CONSEQUENCES OF POSITIVE TEST RESULTS. An employee who tests positive shall have the right to challenge the accuracy of the test results. Such employee shall be subject to unannounced testing for a period of one year following the inception of treatment. If the employee violates the terms of treatment or again test positive during such period, he/she shall be subject to immediate discharge.
CONSEQUENCES OF POSITIVE TEST RESULTS. 20.6.1 Reporting for work with alcohol in excess of .02 grams/100 ml in the bloodstream will be a basis for disciplinary action consistent with Article 17.
CONSEQUENCES OF POSITIVE TEST RESULTS. A. Confirmed Breath Alcohol Test Result Between 0.02 and 0.04 An employee with a breath alcohol concentration result between 0.02 and 0.04 shall be removed from duty without pay for twenty-four (24) hours or a retest below 0.02.
CONSEQUENCES OF POSITIVE TEST RESULTS. After learning of a Bargaining Unit Member whose random drug test is positive or whose alcohol test result is 0.04 or greater, the City will suspend the safety-sensitive employee until he/she has been evaluated by the SAP, completed all recommended treatment, and taken a return-to-duty drug and/or alcohol test with a verified negative result. During the suspension period, the employee will be allowed to use accrued earned days and vacation time, if any. If the employee has no accrued earned day or vacation time, or if they are exhausted during the suspension, the employee may use accrued sick leave, if any. The second positive result in any type of drug and/or alcohol test (transfer, random, reasonable suspicion, post-accident, return-to-duty, or follow-up) will result in immediate termination.
CONSEQUENCES OF POSITIVE TEST RESULTS. A. If the confirmation test results indicate an alcohol concentration equal to or greater than 0.02%, or if the employee has engaged in the prohibited use of a controlled substance as defined herein, the employee will be removed from all duties and may be subject to discipline. No return to duty will be permitted until the employee has been evaluated by a substance abuse professional (“SAP”) chosen by the County, has complied with any treatment recommendations, and has been cleared for return to duty by the “SAP.” Thereafter, a “return to duty” alcohol or drug test must be performed with satisfactory results. A satisfactory result will be less than 0.02% blood alcohol concentration, and/or one that is verified as negative for all controlled substances.
