Common use of Consequences of termination or expiry Clause in Contracts

Consequences of termination or expiry. (a) The University shall be entitled to recover all losses and costs whatsoever that arise from termination of this Agreement pursuant to clause 8(b), clause 9 or clause 10. (b) The Occupant agrees that if: (i) the University terminates this Agreement in accordance with clause 8(b); or (ii) they permanently vacate the Room prior to the Termination Date (notwithstanding the notice provided in clause 9(a)); or (iii) the University terminates this Agreement for Default pursuant to clause 10, the Occupant will remain liable to pay the Occupancy Fee until the earlier of: (a) the Termination Date; or (b) if the Occupant has been granted a Fieldwork Concession or Leave of Absence Concession, the date that the University enters into a replacement Occupancy Agreement for the Room; (c) Where this Agreement has been terminated for any reason prior to the Termination Date, the University will make reasonable endeavours to locate another occupant that is acceptable to the University to occupy the Room. (d) The Occupant agrees that an Early Termination Fee and other administration charges associated with early vacation of the Room will be paid prior to the Occupant’s departure as described at: xxxx://xxx.xxx.xxx.xx/xxxxx/xxxxxxxxxxxxx/xxxxxx-xxxxxxxxxx/xxxxxxxxxxxxx-xxxx where the Occupant is held to this agreement to pay the remainder of their rent until their agreement termination date (e) Upon expiry or termination of this Agreement for whatever cause, the University may remove any fixtures, fittings and/or the Occupant’s personal property from the Room and store the same at the expense of the Occupant without being deemed guilty of conversion or becoming liable for any loss or damage in relation to removing and storying the Occupant’s personal property. (f) Any notice required under this Agreement shall be sufficiently served on the Occupant by: i. personal service; or

(f) Any notice required under this Agreement shall be sufficiently served on the Occupant by: i. : (i) personal service; or (ii) by mailing any notice to the Occupant's last known place of residence; or (iii) by email.

(a) 11.1 The University shall be entitled to recover all losses and costs whatsoever that arise from termination of this Agreement pursuant to clause 8(b), clause 9 or clause 10Agreement. (b) 11.2 The Occupant agrees that if: (i) 11.2.1 the University terminates this Agreement in accordance with clause 8(b); or9.1.2; (ii) 11.2.2 they permanently vacate the Room prior to the Termination End Date (notwithstanding without the notice provided in clause 9(a))written consent of the University; or (iii) 11.2.3 the University otherwise terminates this Agreement for Default pursuant to clause 10, the Occupant will remain liable to pay the Occupancy Fee Tariff until the earlier of: (a) 11.2.4 the Termination End Date; or (b) if the Occupant has been granted a Fieldwork Concession or Leave of Absence Concession, 11.2.5 the date that the University enters into a replacement Occupancy Agreement for the Room;. (c) Where this 11.3 If the University agrees to terminate the Agreement has been terminated for any reason prior to the Termination End Date, the University will make reasonable endeavours to locate another occupant that is acceptable to the University to occupy the Room. (d) The Occupant agrees that an Early Termination Fee and other administration charges associated with early vacation of the Room will be paid may apply prior to the Occupant’s departure as described at: xxxx://xxx.xxx.xxx.xx/xxxxx/xxxxxxxxxxxxx/xxxxxx-xxxxxxxxxx/xxxxxxxxxxxxx-xxxx where the Occupant is held to this agreement to pay the remainder of their rent until their agreement termination datexxxx://xxx.xxx.xxx.xx/xxxxx/xxxxxxxxxxxxx/xxxxxx-xxxxxxxxxx/xxxxxxxxxxxxx-xxxx. (e) 11.4 Upon expiry or termination of this Agreement for whatever cause, the University may remove any fixtures, fittings and/or the Occupant’s personal property from the Room and store the same at the expense of the Occupant without being deemed guilty of conversion or becoming liable for any loss or damage in relation to removing and storying the Occupant’s personal property. (f) 11.5 Any notice required under this Agreement shall be sufficiently served on the Occupant by: i. : 11.5.1 personal service; or 11.5.2 by mailing any notice to the Occupant’s last known place of residence; or 11.5.3 by email.
