Common use of Consequential Damages for Gross Negligence or Willful Misconduct Clause in Contracts

Consequential Damages for Gross Negligence or Willful Misconduct. In addition to the liquidated damages imposed under this Section 10, each Member shall be liable for consequential damages in connection with a breach of this Agreement resulting from the Member’s gross negligence or willful misconduct. Each Active Member shall be liable for the consequential damages arising out of or related to the gross negligence or willful misconduct of the captain operating such Active Member’s vessel(s).

In 11 addition to the liquidated damages imposed under this Section 10, each Member shall be liable for 12 consequential damages in connection with a breach of this Agreement resulting from the Member’s 13 gross negligence or willful misconduct. Each Active Member shall be liable for the consequential 14 damages arising out of or related to the gross negligence or willful misconduct of the captain operating 15 such Active Member’s vessel(s).

In addition to the 35 liquidated damages imposed under this Section 10by the Enforcement Committee, each Member member shall be liable for 36 consequential damages in connection with a breach of this Agreement agreement resulting from the Member37 member’s gross negligence or willful misconduct. Each Active Member active member shall be liable for the 38 consequential damages arising out of or related to the gross negligence or willful misconduct of 39 the captain operating such Active Memberactive member’s vessel(s).
