AT-SEA MONITORING PROVISIONS. 3 1. ASM Contracting: Sector 10 will contract with one or more of the companies approved by 4 NOAA Fisheries to provide at-sea monitoring and will notify NOAA Fisheries of its selection no 5 later than April 30, 2019. 7 2. Coverage Rate: Sector 10 will deploy at-sea monitors in a way to achieve 31 % of trips that is 8 random and representative of fishing activities of the sector. 10 3. ASM Program: Sector 10 will use the NOAA Fisheries designed ASM program. NOAA 11 Fisheries ASM Standards and Description of the NMFS ASM Program can be found in Exhibit E. 13 4. Electronic Monitoring Provision: Sector vessels may use electronic monitoring (EM) 14 systems (i.e. cameras, gear sensors, video recording equipment) in lieu of human at-sea monitors 15 (ASM) to meet federal ASM requirements for FY 2019. 17 a. Vessels may be authorized to use EM only under a valid Exempted Fishing Permit issued 18 by NOAA Fisheries. 20 b. Vessels fishing under the EFP must abide by all operational and reporting requirements 21 and conditions outlined in the EFP and the vessel’s Vessel Monitoring Plan. 23 c. Vessels using EM are required to declare their intent to take a sector trip using the Pre- 24 Trip Notification System (PTNS), consistent with standard notification protocols listed in 25 the Harvesting Rules in Exhibit C. 27 d. Vessels fishing under the EFP are not exempt from the requirement to carry NEFOP 28 observers when selected for coverage. PTNS notification and selection procedures for 29 NEFOP coverage under EM remains the same. 1 ENFORCEMENT PROVISIONS

  • Governing Provisions This Agreement is made under and subject to the provisions of the Plan, and all of the provisions of the Plan are also provisions of this Agreement. If there is a difference or conflict between the provisions of this Agreement and the provisions of the Plan, the provisions of the Plan will govern. By signing this Agreement, the Grantee confirms that he or she has received a copy of the Plan.

  • Scheduling Provisions The scheduling and premium provisions relating to consecutive weekends off in Article 16 do not apply to employees who accept positions under this provision.

  • Implementation of Agreement Each Party must promptly execute all documents and do all such acts and things as is necessary or desirable to implement and give full effect to the provisions of this Agreement.

  • Controlling Provisions In the event of any inconsistencies between the provisions of this Amendment and the provisions of any other Loan Document, the provisions of this Amendment shall govern and prevail. Except as expressly modified by this Amendment, the Loan Documents shall not be modified and shall remain in full force and effect.

  • LIMITATIONS ON REVERSE ENGINEERING, DECOMPILATION AND DISASSEMBLY You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

  • NOTIFICATION OF PUBLIC EVENTS AND MEETINGS 2 A. CONTRACTOR shall notify ADMINISTRATOR of any public event or meeting funded in 3 whole or in part by the COUNTY, except for those events or meetings that are intended solely to serve 4 clients or occur in the normal course of business. 5 B. CONTRACTOR shall notify ADMINISTRATOR at least thirty (30) business days in advance 6 of any applicable public event or meeting. The notification must include the date, time, duration, 7 location and purpose of the public event or meeting. Any promotional materials or event related flyers 8 must be approved by ADMINISTRATOR prior to distribution. 9

  • Implementation and Review The Parties shall consult annually, or as otherwise agreed, to review the implementation of this Chapter and consider other matters of mutual interest affecting trade in services. (10) 10 Such consultations will be addressed under Article 170 (Free Trade Commission) of Chapter 14 (Administration of the Agreement).

  • Testing Procedure Limitations The Asset Representations Reviewer will only be required to perform the testing procedures listed under “Tests” in Schedule A, and will have no obligation to perform additional procedures on any Subject Lease or to provide any information other than a Review Report indicating for each Subject Lease whether there was a Test Pass or a Test Fail for each Test, or whether the Subject Lease was a Test Complete and the related reason. However, the Asset Representations Reviewer may provide additional information about any Subject Lease that it determines in good faith to be material to the Review.

  • Implementation of the Agreement Regulations of this Agreement relating to investments who investors of one Contracting Party realized before or after the entry into force of this Agreement, with what shall apply from the moment of its entry into force, provided that such investments conducted in accordance with the laws of that Party Contracting.
