Construction and Installation. In the event PSINet desires to connect any of its POPs to any IXC POP, PSINet may construct, install, operate and maintain a connection facility (the "POP-to-POP Interconnect Facility") between the PSINet premises and the IXC Premises so long as PSINet meets or exceeds the standards set forth in Section 7.2. PSINet shall provide at its expense all necessary rights-of-way, permits, equipment and IXC-approved materials to construct and install each POP-to-POP Interconnect Facility, including, but not limited to, cables and conduit and any labor charges associated therewith. If necessary, and where applicable, IXC shall use commercially reasonable efforts to provide PSINet, at PSINet's expense, access to existing building entrance facilities, if available, to access and exit IXC POPs. The demarcation point for PSINet shall be in the IXC POPs at the Connect Panel or the DSX panel, as appropriate.
Construction and Installation. The Developer, at its sole cost and expense, shall construct and install the Water and Sewage Facilities in accordance with the approved Plans and Specifications.
Construction and Installation. The Developer will construct and install each Building System in accordance with the Design Guide and with the final Thermal Energy delivery parameters agreed and approved pursuant to Section 3.1. The Developer will keep Corix reasonably informed regarding the progress of construction and installation of each Building System. Without limiting the generality of the foregoing, the Developer will provide at least 90 days’ written notice to Corix of the Developer’s scheduled target date (the “Target Date”) by which: (a) the Developer will have completed the construction and installation of each Building System in accordance with this Section 3.2; (b) the Developer will have each Building System ready for connection to the Energy Transfer Station in accordance with Section 3.3; and (c) each Building will be ready to receive Energy Services from Corix.
Construction and Installation. Contractor shall provide and furnish to CUC the following services in accordance with all terms, conditions, drawings, specifications and standards set forth in this Agreement.
(i) Within forty-five (45) Days after the execution of this Agreement, Contractor shall prepare and deliver to CUC, for CUCs reference, a draft comprehensive Project implementation plan, which shall include a Schedule of Work, an organizational chart and a document distribution chart;
(ii) Contractor shall prepare and update all progress schedules and include such in written progress reports to CUC each month;
(iii) Contractor shall provide all design and engineering for the Project and the Site, including the preparation of all drawings;
(iv) Contractor shall furnish all labor, supervision and all tools necessary to perform the Work and construct the Project, and shall construct the Project and direct and support start-up and operation of the Plant as delineated in this Agreement;
(v) Contractor shall procure and provide all Plant Equipment (together with all services in relation thereto), transport all Plant Equipment and materials to the Site, including the cost of ocean freight and the fulfillment of all applicable import and customs requirements, procedures and formalities;
(vi) With the cooperation of CUC, Contractor shall use reasonably prudent construction practices to (a) perform the Work, (b)coordinate all Work with CUC, (c) coordinate all Work performed by its Subcontractors, (d) keep to Work on schedule, (e) timely report the status of the progress of the Work to CUC, (f) pay its Subcontractors in a timely manner, and (g) cause all of its Subcontractors to comply with all applicable terms of this Agreement;
(vii) Contractor shall provide Plant inspection, Plant start-up, Plant testing, and operations training;
(viii) In accordance with Section 12 hereof, Contractor shall correct all nonconforming Work and any deficiencies in the Plant. During construction, inadequate, nonconforming or damaged equipment and materials shall be replaced or repaired by Contractor after full consultation with CUC;
(ix) Subject to the provisions of Section 5, Contractor shall perform all Change Orders and all other necessary acts to fulfill Contractor's obligations under this Agreement; and
(x) Contractor shall provide all necessary housing facilities and construction utilities, including power and water, necessary to fulfill Contractor's obligations to provide the Plant as set forth in this A...
Construction and Installation. The Property Owner and the Contractor, at their sole cost and expense, shall construct and install the Work in accordance with the approved Plans and specifications.
Construction and Installation. Subject to other provisions of this Contract, ESCO will act as a turn-key general contractor assuming total responsibility for all phases of construction and installation, including but no limited to: (a) selecting Subcontractors in concert with the School District; (b) awarding Subcontracts in accordance with Exhibit IV (Economic Opportunity Plan) as approved by the School District and set forth in Schedule O (School District Approved Subcontractor List) and notifying the School District in writing of any changes in first-tier subcontractors prior to their selection and subcontract awards; (c) preparing and submitting all Design and Engineering Documents for approval by the School District’s Project Manager in accordance with Paragraph 7.2.2 (Design and Engineering Approval); (d) obtaining all necessary permits, licenses and approvals and coordination during installation in accordance with the provisions of Articles 10 (Coordination and Construction Requirements) and 33 (Compliance with Applicable Laws); (e) purchasing of Equipment, software and materials for the Selected ECMs; (f) installation and start-up of the Equipment, software and materials for the Selected ECMs’ (g) progress inspections during installation; (h) developing and presenting subcontractor punch lists after each inspection; (i) receiving and evaluating record drawings and operation and maintenance manuals from Subcontractors; (i) training of School District staff and service providers on proper operation and service of the newly installed Selected ECMs in accordance with the provisions of Article 9 (Training by ESCO); and (k) final inspection and recommendation for approval by the School District.

Construction and Installation. (a) After receipt of an initial franchise, a Grantee shall proceed with due diligence to install and begin operation of the franchise.
(b) Failure on the part of the Grantee to commence and diligently pursue
(d) The shall be constructed and operated in accordance with all adopted City, state and national construction and electrical codes.
Construction and Installation. Contractor shall provide, install, complete and pay for all labor, Equipment, tools, supplies, construction equipment and machinery, utilities and consumables, transportation and other facilities and services (including any temporary materials, equipment, supplies and facilities) necessary for the proper execution and completion of the Work, except that Owner shall pay for and cause delivery of the Owner-Furnished Equipment that will be inspected, off loaded, stored, secured and installed by Contractor. All construction and installation performed by Contractor under this Agreement shall be in accordance with the given manufacturer’s written instructions and the specific instructions of the manufacturer’s representative, unless otherwise agreed by Owner in advance in writing, sound construction procedures, Prudent Industry Standards and all Legal Requirements.
Construction and Installation. The City hereby consents to the construction and installation of the Renewable Generating Facility by the Developer on the Property at the Developer’s sole cost. The Developer shall request and obtain underground utility information through the various utility companies.
