Means and Methods. 1. The means that may be deployed under the cooperation operations referred to in Article 66 shall include in particular studies, technical assistance, training or other services, supplies and works, and also evaluation and monitoring audits and missions.
2. Community financing, in local or foreign currency, depending on the needs and nature of the operation, may cover:
(a) government budget expenditures to support reforms and policy implementation in the priority sectors identified through a policy dialogue;
(b) investment (with the exception of the purchase of buildings) and equipment;
(c) in certain cases and in particular where a programme is implemented by a non-government partner, recurrent expenditure.
3. Contribution from the partners defined in Article 67 shall in principle be required for each cooperation operation. The nature and amount of this contribution shall be adapted to the possibilities of the partner and the nature of operations.
4. Opportunities may be sought for coherence and complementarity with other providers of funds, particularly the Member States of the European Union. 5. Appropriate steps will be taken by both Parties to ensure that the Community character of development cooperation under this Agreement is made known to the general public.

In no event shall the Authority or Indemnitees have any responsibility or liability for design or construction means, methods, techniques, sequences, or procedures, or for safety precautions and programs in connection with the Trade Contractor Work, notwithstanding any of the rights and authority granted the Authority and Indemnitees in the Trade Contract Agreement.

Means and Methods. 14.3.1 The Contractor shall, at all times, be responsible for the efficiency and adequacy of its planning, co-ordination with its Subcontractors, design, securing of approvals, means and methods of performance, materials and equipment, irrespective of whether the Contractor acts as a result of any advice or reviews of the Owner.
14.3.2 The Contractor shall, whenever required by the Owner, submit details of the arrangements and methods which the Contractor proposes to adopt for performance of its obligations under this Contract. No significant alteration to these arrangements and methods shall be made without the same being previously notified to the Owner.

The means and methods of construction shall be such as the Contractor may choose; subject, however, to the City’s right to reject the Facilities for which the means or method of construction does not, in the judgment of the City, assure that the Facilities are constructed in accordance with BWA’s Standard Construction Criteria and Design Criteria for Domestic Wastewater Systems, Chapter 217, and Rules and Regulations For Public Water Systems, Chapter 290.
Means and Methods. The ESCO's means and methods for the performance of the Work must be those best adapted for the safe, efficient, and expeditious prosecution of the Work, with a minimum of interference to adjoining work sites, to adjoining properties, and to public traffic and convenience. The ESCO shall prosecute the Work vigorously, without delay, and with such workforces and equipment as shall be satisfactory to the Project Manager. The ESCO shall supervise and direct the Work, and ESCO shall be solely responsible for and have control over all construction means, methods, techniques, sequences and procedures and for coordinating all portions of its Work under this Contract. Before commencing the Work, the ESCO, when required by the Project Manager, shall submit for approval its proposed methods of prosecution of the Work, including the maintenance of both vehicular and pedestrian traffic; underpinning, bulkheading, shoring; sinking foundations; handling spoil; lighting; fencing; street surfaces; drainage; and all other branches of its work operation. Such approval is intended to safeguard the PEA and City's interest, but such approval will not be deemed to relieve the ESCO of its obligation or responsibility for the safe and proper conduct of the Work. The ESCO shall at all times ensure that its work site, and its Subcontractor’s personnel, while performing any part of the Work under this Contract, are and remain free of the influence of alcohol or illegal drugs. The ESCO shall at all times enforce good discipline and order among its employees, and shall not employ any unfit Person or anyone not skilled in the task assigned. Any contact by the ESCO or its employees with adjacent property owners, passing motorists or pedestrians, and the general public shall at all times be professional, courteous, and respectful.
Means and Methods. BE shall supervise and direct the Services and have control over all means, methods, techniques, sequences and procedures related to the Services. The Services shall not include governmental permits or fees of any kind; testing, removal and disposal of contaminated or hazardous materials, or of any materials containing hazardous material as defined by the EPA; relocating Client’s property; restoration related to Client’s prior Project activities, including repair of damage to roadways, driveways, or sidewalks resulting from equipment or vehicles.

Architect will neither have control over or charge of, nor be responsible for, the construction means, methods, techniques, sequences or procedures, or for safety precautions and programs, in connection with the Work, since these are solely CM/GC’s, Subcontractor’s and Supplier’s responsibilities under the Contract Documents. Architect will neither have control over or charge of, nor be responsible for, acts or omissions of CM/GC, Subcontractors, Suppliers or their agents or employees, or of any other persons performing any portion of the Work. For clarity, this Section applies to all Phases of the Project.
