Construction Inspection. EFSEC shall provide plan review and inspection of construction for all Project structures, underground and overhead electrical lines, and other Project facilities to ensure compliance with this Agreement. Construction shall be in accordance with the approved design and construction plans, and other relevant regulations. EFSEC may contract with Yakima County, another appropriate agency, or an independent firm to provide these services.
Construction Inspection. If allowed under applicable grants and funding mechanisms, the selected Team may be tasked with performing periodic construction inspection throughout the life of the project. Periodic inspection reports will be maintained by the Team and provided upon request to the City. The Team will be responsible for coordinating pre-construction meeting, review of pay requests, and final punch list for construction closeout. The Team will be responsible for performing the following tasks throughout construction as part of the Construction Inspection Services:  Coordinate pre-construction meeting  Respond to any construction related questions, unforeseen conditions, etc. that arise  Review and recommendation for payment of Pay Requests submitted by Contractor throughout construction  Document/track all Direct Purchase Orders under the Tax Exempt Agreement submitted by Contractor during construction  Review and preparation based on verified pricing of any Change Orders throughout construction; these will be submitted to the City for approval  Performance of all environmental inspections as required by local, state, and federal permits applicable during construction.  Final inspection and punch list for construction close out This is an acknowledgement that FEMA financial assistance will be used to fund the contract, as well as any other available funding from the federal government or the State of Florida. The awarded contractor will comply will all applicable state and federal law, regulations, executive orders, FEMA policies, procedures, and directives. The Federal Government is not a party to the awarded contract and is not subject to any obligations or liabilities to the non-Federal entity, contractor, or any other party pertaining to any matter resulting from the contract. The contractor acknowledges that 31 U.S.C. Chap. 38 (Administrative Remedies for False Claims and Statements) applies to the contractor's actions pertaining to this contract. Federal requirements include, but are not limited to the following. In the event that the parties confirm that certain requirements do not apply to certain tasks, the parties will stipulate to that in the contract or task order.
Construction Inspection a. The ENGINEER will have a part-time Resident Project Representative (RPR) on Site. The RPR will conduct specific inspections for the Project, including but not limited to underground construction, foundations, structures and site improvements. The duties, responsibilities and the limitations of authority of the RPR, including designated assistants, are as follows: i. RPR is ENGINEER’s agent at the site, will act as directed by and under the supervision of ENGINEER, and xxxx xxxxxx with ENGINEER regarding RPR’s actions. ii. RPR’s dealings in matters pertaining to the on-site work shall in general be with ENGINEER and Contractor, keeping OWNER and City advised as necessary, RPR’s dealings with Subcontractors shall only be through or with full knowledge and approval of Contractor. iii. RPR shall communicate with OWNER with the knowledge of and under the direction of ENGINEER. b. Duties and Responsibilities of RPR: i. Schedules: Review the progress schedule, schedule of Shop Drawing submittals and schedule of values prepared by Contractor and consult with ENGINEER concerning acceptability. ii. Conferences and Meetings: Attend meetings with Contractor, such as preconstruction conferences, progress meetings, job conferences and other project-related meetings, and prepare and circulate copies of minutes thereof, unless directed otherwise. iii. Liaison: 1. Serve as ENGINEER’s liaison with Contractor, working principally with the Contractor’s superintendent to communicate the intent of Contract Documents and assist ENGINEER in serving as OWNER’s liaison with Contractor when Contractor’s operations affect City’s on-site operations. 2. Assist in obtaining additional details or information from OWNER, when requested. iv. Shop Drawings and Samples: 1. Record date of receipt of Shop Drawings and Samples. 2. Receive samples which are furnished by Contractor and notify ENGINEER of availability of Project Samples for examination. 3. Advise ENGINEER and Contractor, of the commencement of any work requiring a shop drawing or Sample, if the submittal has not been approved by ENGINEER. v. Review of Contractor’s Work - Inspections and Tests: 1. Conduct on-site observations of the Work in progress to determine if the work is proceeding in general accordance with the Contract Documents. 2. Code Review of Plans & Specification is to be performed by a PA L&I Certified Third Party Agency OR its equivalent NJDCA Building ICS or HHS Certification. Construction Inspection. All construction activity shall be subject to inspection and approval by LICENSOR. Inspection may be performed at any time during the course of the construction activity reasonably determined by LICENSOR, at LICENSEE's expense. Construction work performed without approval of LICENSOR will not be accepted and shall be removed or uninstalled at LICENSEE's sole expense. LICENSEE shall be solely responsible for all costs associated with said inspection and approval of such work by LICENSOR.

Construction Inspection. A. FIELD OBSERVATION – Full Time (As assigned) i. Engineer’s site observation shall be at the times agreed upon with the Owner. Engineer will provide Resident Engineers at the construction site on a full-time basis of forty (40) hours per week from Monday through Friday, not including legal holidays, as deemed necessary by the Engineer, to assist the Contractor with interpretation of the Drawings and Specifications, to observe in general if the Contractor’s work is in conformity with the Final Design Documents, and to monitor the Contractor’s progress as related to the Construction Contract date of completion. Through standard, reasonable means, Engineer will become generally familiar with observable completed work. If Engineer observes completed work that is inconsistent with the construction documents, that information shall be communicated to the contractor and Owner to address. Engineer shall not supervise, direct, control, or have charge or authority over any contractor’s work, nor shall the Engineer have authority over or be responsible for the means, methods, techniques, sequences, or procedures of construction selected or used by any contractor, or the safety precautions and programs incident thereto, for security or safety at the site, nor for any failure of any contractor to comply with laws and regulations applicable to such contractor’s furnishing and performing of its work. Engineer neither guarantees the performance of any contractor nor assumes responsibility for any contractor’s failure to furnish and perform the work in accordance with the contract documents, which contractor is solely responsible for its errors, omissions, and failure to carry out the work. Engineer shall not be responsible for the acts or omissions of any contractor, subcontractor, or supplier, or of any of their agents or employees or any other person, (except Engineer’s own agents, employees, and consultants) at the site or otherwise furnishing or performing any work; or for any decision made regarding the contract documents, or any application, interpretation, or clarification, of the contract documents, other than those made by the Engineer. ii. Provide the necessary base lines, benchmarks, and reference points to enable the Contractor to proceed with the work. iii. Construction Inspection. A statement has been provided by ----------------------- the Construction Inspector to Lender stating that the Construction Inspector has reviewed the Plans and Specifications and the cost breakdown and that the proceeds of the Loan and the funds supplied pursuant to Section 5.01(hh) above are adequate to complete the construction of the Improvements on the Project. The appointment of a Construction Inspector shall not place any duty or responsibility upon Lender to inspect the Improvements or any obligation or liability upon Lender regarding the quality of construction or the absence therefrom of defects.
