Common use of CONSTRUCTION OF THE PROJECT/UNIT Clause in Contracts

CONSTRUCTION OF THE PROJECT/UNIT. The Allottee has seen the proposed lay out plan, specifications, amenities and facilities of the [Apartment] and accepted the f xxxx plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the [Please insert the relevant State laws] and shall not have an option to make any variation/alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

The Allottee has seen the proposed lay out layout plan, specifications, amenities and facilities of the [Apartment] Unit and accepted the f xxxx floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement] as mentioned in the Schedule which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications. Subject , amenities and facilities, subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the [Please insert the relevant State laws] Municipal Authority and shall not have an option to make any variation/alteration/ variation / alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications. Subject , amenities and facilities, subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-bye- laws, FAR and density norms and provisions prescribed by the [Please insert the relevant State laws] laws and shall not have an option to make any variation/alteration/ alteration/modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the [Please insert the relevant State laws] Municipal Laws and shall not have an option to make any variation/alteration/ alteration/modification in such plans, other than in the manner provided under the ActAct and/or for the benefit of the Allotte(s) and/or as elsewhere stated in this Agreement, and breach of this term by the Promoter shall constitute a material breach of the Agreement.

CONSTRUCTION OF THE PROJECT/UNIT. The Allottee has seen the proposed lay out plan, specifications, amenities and facilities specifications of the [Apartment] Commercial Space and the Car Parking Space (as morefully mentioned in the Annexure to this Agreement) and accepted the f xxxx planPayment Plan, payment plan and the specificationsfloor plans, amenities and facilities layout plans [annexed along with this Agreement] which has been approved by the competent authority, as represented by the PromoterOwner. The Promoter Owner shall develop the Project in accordance with the said Plan and/or such plans layout plans, floor plans and specifications. Subject to the terms in this Agreement, the Promoter Owner undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the [Please insert the relevant State laws] Concerned Authorities and shall not have an option to make any variation/alteration/ modification variation /alteration /modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter Owner shall constitute a material breach of the Agreement.

The Allottee has seen been the proposed lay out layout plan, specificationsspecification, amenities and facilities facility of the [said Apartment] /Unit/Office Space and accepted the f xxxx floor plan, payment plan and the specificationsspecification, amenities and facilities [facility (annexed along with this Agreement] which Agreement)which has been approved by the competent authority, as represented by the Promoterpromoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans plan and specifications. Subject specification, amenities and facility,subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the [Please insert WBHIRA (the relevant State state laws] ) and shall not have an option to make any variation/alteration/ alternation/modification in such plans, other than in the manner provided under the Act, and .,and breach of this term by the Promoter shall constitute a material breach of the Agreement.
