Common use of CONSTRUCTION REFUSE Clause in Contracts

CONSTRUCTION REFUSE. i. The Owner agrees to regularly dispose of all construction refuse and debris in an orderly and sanitary fashion. If the Owner fails to remove and dispose of construction refuse and debris to the satisfaction of the Town, the Town may give written notice to the Owner. If the Owner fails to dispose of the refuse and debris within forty-eight (48) hours after having received a written request from the Town to do so, the Town may, without further notice, undertake such removal and disposition and the cost thereof shall be paid by the Owner forthwith upon demand, which costs shall include all expenses incurred by the Town in carrying out such removal and disposal. Any amount that remains owing shall form a lien on the Lands and may be collected by action or as municipal taxes pursuant to Section 446 of the Municipal Act, 2001, supra.
