Consumers Served by Third Clause Samples
The 'Consumers Served by Third' clause defines the rights and obligations of parties when consumers are provided services or products through a third party rather than directly by the contracting party. Consumers Served by Third. Parties - Consumers being served under other competitive supply programs offered by third-parties will not be automatically enrolled as Participating Consumers under this ESA when such program terminates or is otherwise completed. Competitive Supplier agrees that consumers under such third-party competitive supply programs may affirmatively opt-in and receive All-Requirements Power Supply at the Competitive Supplier’s discretion, at the aggregation rate.
