Common use of Consumers Served by Third Clause in Contracts

Consumers Served by Third. Parties - Consumers being served under other competitive supply programs offered by third-parties will not be automatically enrolled as Participating Consumers under this ESA when such program terminates or is otherwise completed. Competitive Supplier agrees that consumers under such third-party competitive supply programs may affirmatively opt-in and receive All-Requirements Power Supply at the Competitive Supplier’s discretion, at the aggregation rate.

Consumers Served by Third. Parties - Consumers being served under other competitive supply programs offered by third-parties will not be automatically enrolled as Participating Consumers under this ESA when such program terminates or is otherwise completed. Competitive Supplier agrees that consumers under such third-party competitive supply programs may affirmatively opt-in and receive All-Requirements Power Supply at the Competitive Supplier’s discretion, at the aggregation raterate at the time any such Eligible Consumer notifies Competitive Supplier of the decision to opt-in.
