Contingent Upon Appropriations. Where activities provided for in this Agreement extend beyond the current fiscal year, continued expenditures by WAPA are contingent upon Congress making the necessary appropriations required for the continued performance of WAPA’s obligations under its Amended and Restated Western Joint Dispatch Agreement with SPP. In case such appropriation is not made, SPP hereby releases WAPA from its contractual obligations and from all liability due to the failure of Congress to make such appropriation. Consistent with this Section 12.5, Section 12.2, and the Anti-Deficiency Act, 31 U.S.C. §§ 1301, 1341-1342, 1349-1351, and 1511-1519, Section 6.2 of this Agreement is inapplicable to WAPA.

No term or provision of this Agreement will constitute or be construed as a commitment or a requirement that the United States obligate or pay funds in contravention of the Anti-Deficiency Act, 31 U.S.C. § 1341, or any other applicable law or regulation. Contingent Upon Appropriations. The United States shall make every effort to obtain appropriations as necessary for continued participation in this Agreement; however, it is understood that the participation of the United States is contingent upon obtaining the necessary appropriations and, if such necessary appropriations are not obtained from Congress, then the other Parties hereby agree to release and discharge the United States from any financial liability or responsibility in connection with the continued participation and associated rights in this Agreement; provided, that if the United States is unable to continue participation as a result of non- appropriation of funds, the United States will, at the time sufficient funds are appropriated, make payment to the appropriate Party or Parties equal to the amount plus interest calculated pursuant to Section 13.5 herein, which become due under this Agreement, if funds had been timely appropriated. Payment by the United States shall constitute performance by the United States as if funds had been appropriated and payment made as scheduled. Full reinstatement of the United States under the terms of this Agreement shall be granted only if funds are appropriated in amounts to cover any obligations which might arise by virtue of the application of Section 26 herein.
