Continuing Effect of the Agreement. Except as specifically set forth herein, the Agreement shall remain in full force and effect and shall not be waived, modified, superseded or otherwise affected by this Amendment. This Amendment is not to be construed as a release, waiver or modification of any of the terms, representations, warranties, covenants, rights or remedies set forth in the Agreement, except as specifically set forth herein.
Continuing Effect of the Agreement. Except as expressly amended or modified hereby, the provisions of the Agreement are and shall remain in full force and effect and are hereby ratified and confirmed.

Continuing Effect of the Agreement. Except as specifically set forth in this First Amendment, the Agreement shall remain unmodified and in full force and effect.
Continuing Effect of the Agreement. This Amendment shall not ---------------------------------- constitute an amendment of any provision of the Agreement or the Note not expressly referred to herein and shall not be construed as a consent to any action on the part of the Company that would require a waiver or consent of the Bank except as expressly stated herein. The provisions of the Agreement and the Note that are not expressly amended or modified hereby are and shall remain in full force and effect, and are hereby ratified and confirmed, including without limitation, the negative pledge on assets of the Company as set forth in Section 6.5

Except as expressly amended or modified herein, the provisions of the Agreement are and shall remain in full force and effect.
Continuing Effect of the Agreement. This Amendment is limited solely to the matters expressly set forth herein and does not constitute an amendment, waiver or consent to any provision of the Agreement other than as set forth herein. Except as expressly set forth in this Amendment, the Agreement remains in full force and effect, and the Parties acknowledge and agree that all of their respective obligations hereunder and under the Agreement shall be valid and enforceable and shall not be impaired or limited by the execution or effectiveness of this Amendment except to the extent specified herein. From and after the date hereof, each reference in the Agreement and in any exhibits attached thereto to “this Agreement”, “hereunder”, “hereof”, “herein” or words of similar import shall mean and be a reference to the Agreement after giving effect to this Amendment.
Continuing Effect of the Agreement. Except as expressly modified above, the Agreement remains in full force and effect.
