Contract Formation. Subject to FAR Sections 1.601(a) and 43.102, the Government Order must be signed by a duly warranted contracting officer, in writing. The same requirement applies to contract modifications affecting the rights of the parties. All terms and conditions intended to bind the Government must be included within the contract signed by the Government.
Contract Formation. A legally enforceable agreement shall arise upon the signing or acknowledgement electronically by Contractor of the Contract in Oracle E-Business Suite iSupplier (the "Procurement System") or, if Contractor is not enabled in the Procurement System, upon the mailing or delivery by other means of the Contract or another writing manifesting acceptance of Contractor's offer; provided, however, that if Contractor's offer contains terms additional to or different from the terms on which quotations were requested by Con Edison which are not accepted in writing by Con Xxxxxx, a legally enforceable agreement shall not arise until the signing or acknowledgement electronically by Contractor of the Contract in the Procurement System or, if Contractor is not enabled in the Procurement System, by the signing by Contractor of the Contract or a copy of the Contract or such other writing as may be issued by Con Edison (or another document expressing Contractor's acceptance thereof), or Contractor's commencement or continuation of the Work following its receipt of the Contract or such other writing, such Work signifying Contractor's acceptance of the terms thereof.
Contract Formation. The Buyer shall issue a notice of award, if any, to successful respondent(s), however, no contract shall be formed between respondent and the Buyer until the Buyer signs the Contract. The Buyer shall not be liable for any costs incurred by a respondent in preparing or producing its response or for any work performed before the Contract is effective.

Contract Formation. The Contractor shall provide goods and services according to the terms and conditions set forth in this Contract, the Solicitation, and all other attachments named herein which are attached hereto and incorporated by reference.

Contract Formation a) If this Contract results from a sealed bid offered in response to a solicitation conducted pursuant to Chapters 2 (commencing with section 10290), 3 (commencing with section 12100), and 3.6 (commencing with section 12125) of Part 2 of Division 2 of the Public Contract Code (PCC), then Contractor's bid is a firm offer to the State which is accepted by the issuance of this Contract and no further action is required by either party.
b) If this Contract results from a solicitation other than described in paragraph a), above, the Contractor's quotation or proposal is deemed a firm offer and this Contract document is the State's acceptance of that offer.
c) If this Contract resulted from a joint bid, it shall be deemed one indivisible Contract. Each such joint Contractor will be jointly and severally liable for the performance of the entire Contract. The State assumes no responsibility or obligation for the division of orders or purchases among joint Contractors.
Contract Formation. We are only obliged to provide you with Services if we accept your Order Form for such Services. Each Order Form, upon acceptance by us, shall be binding on the Parties.
Contract Formation. 2.1 The Client shall submit a request to Digital Origin for each Service required by the Client via the Order Form. The Order Form constitutes the Client's offer to Digital Origin to purchase the relevant Equipment, Leased Equipment and/or Services (as the case may be) on and subject to the terms of the Order Form, these Conditions, and any other Service Specific Conditions referred to as being applicable.
2.2 If Digital Origin is prepared to provide those Services to the Client under this Agreement and such offer is accepted by an authorised representative of Digital Origin signing the Order Form, a Contract shall come into effect and the Client shall not be permitted to cancel the Order Form. In such circumstances, Digital Origin shall become the exclusive provider of those Services to the Client for the Minimum Term and the Client shall purchase those Services only from Digital Origin. The details recorded on the Order Form, together with these Conditions and any other Service Specific Conditions referred to as being applicable to the relevant Contract, shall be the exclusive terms and conditions of the Contract between the parties (to the fullest extent permitted by law) and any such Contract shall be conditional upon the credit status of the Client being to the satisfaction of Digital Origin (in its sole and absolute discretion) and, in respect of a Contract which provides for the supply of:
2.2.1 each individual Service is subject to its own Minimum Term and notice period but, in the absence of a specified notice period for a Service, the default notice period shall be twelve (12) months, such notice not to expire until the end of the Minimum Term or the relevent Subsequent Term. Failure to provide such notice before the end of the Minimum Term or any Subsquent Term shall result in the individual Service automatically renewing for a Subsequent Term or a further Subsequent Term (as the case may be) following expiry of the Minimum Term or the then current Subsequent Term (as the case may be); and/or
2.2.2 Equipment and/or Leased Equipment and/or Installation Services, (without limitation) is subject to the condition in condition 5.1.1 being met; and/or
2.2.3 Network Services, (without limitation) is subject to the conditions in condition 6.2.1 being met; and/or
2.2.4 Managed Services Support Services, (without limitation) is subject to the condition in condition 7.1.1 being met.
2.3 All quotations, estimates and tenders are given and contracts are made...
