Contractor as Client. The Contractor shall procure that the Refurbishment Contractor act as the client's agent for the purposes of the Construction (Design and Management) Regulations 1994 ("the CDM Regulations") in respect of the Refurbishment Works. No later than 13 October 2006 the Contractor shall procure that the Refurbishment Contractor makes and serves on the Health and Safety Executive a declaration in accordance with paragraph (4) of Regulation 4 of the CDM Regulations. The Contractor shall procure that the Refurbishment Contractor shall as soon as possible provide to the Authority a copy of the notice which it receives pursuant to paragraph (5) of Regulation 4 of the CDM Regulations.
Contractor as Client. The Councils hereby appoint the Contractor to act as the only client in respect of the Project. Accordingly within 10 Business Days of the date of each of the Construction Contract, each the Minor Facilities Contract, each contract in respect of either Replacement HWRS and the contract for the Works for the construction of New Technology the Contractor shall make and serve on the Lead Authority an appropriate declaration in accordance with paragraph (4) of Regulation 4 of CDM Regulations. The Contractor shall as soon as possible provide to the Lead Authority a copy of each notice which it receives pursuant to paragraph (5) of Regulation 4 of the CDM Regulations. The Contractor shall ensure that the Construction Contractor and each of the Sub-contractors in respect of the Minor Facilities, New Technology and Replacement HWRS are each aware of the terms of such declaration and shall not at any time prior to the Completion of such Waste Management Facilities (other than the Crowborough HWRS) or earlier termination of the contracts in relation to such Waste Management Facilities (other than the Crowborough HWRS) seek to withdraw, terminate or in any manner derogate from such declaration. The Contractor shall make available to the Lead Authority a copy of any Health and Safety file in respect of each Waste Management Facility (other than the Crowborough HWRS) from the Completion Date of such Waste Management Facility
