Contractor Representation. Contractor represents by signing this contract that it is qualified and possesses the necessary capabilities and sufficient skills, including technical and professional skills where required and has the necessary licenses and certifications to perform the services set forth in this contract.
Contractor Representation. The Contractor has submitted a bid in writing to the Agency and represents self as being competent, skilled, trained, experienced and qualified to undertake and perform those certain services, as set forth in all of the contract documents, as are required in accomplishing fulfillment of the obligations under the terms and conditions of this Contract as an independent entrepreneur.
Contractor Representation. CONTRACTOR represents that it is not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in transactions by any federal, state, or local governmental authority. CONTRACTOR shall immediately notify PROVIDER re- xxxxxxx the circumstances if this representation becomes no longer accurate during the term of this AGREEMENT.
Contractor Representation. It is understood that this Association is acting only as an agent in the negotiation of this Agreement and that it is agent only for those individuals, partnerships, firms, corporations and joint ventures who have authorized it so to act, and in no event shall it be bound as principal or be held liable in any manner for any breach of this Agreement by any of the Contractors for whom it is acting or any employee of such Contractors. It is further agreed and understood that the liabilities of the Contractors who have authorized the negotiation and execution of this Agreement shall be several and not joint.
Contractor Representation. The contractor shall only furnish employees who are competent and skilled for the work under this agreement and have current valid permits and licenses where applicable. Contractor’s personnel, while providing snow removal services shall have a neat and professional appearance. Improper or abusive language or unacceptable or improper conduct shall not at any time be exhibited to the public by the contractor’s employees or such offender will be removed from operations by the contractor or upon request by Miami Township. It shall be the responsibility of the contractor to take all necessary steps to ensure drivers are not under the influence of any substance that may impair judgment while operating a motor vehicle on duty performing work for Miami Township. Alcohol consumption is strictly prohibited and the use of tobacco products is prohibited on all Township owned property including vehicles, buildings and grounds. Drivers shall arrive at the Public Works Facility adequately rested prior to the commencement of work. Drivers shall not operate vehicles and equipment on Township public roadways for a period longer than 8 hours. A Township representative shall be supplied the name and contact number of an appropriate person within the contractor’s employment with whom complaints can be aired and remedied immediately. The Township and the contractor shall investigate all complaints and shall arrange for the correction within 24 hours after the complaint is received. In case of controversy, service shall be provided and the matter referred to the Township.
Contractor Representation. 1. The Contractor shall provide a list of all architect/engineers (i.e., professional architects, engineers, survey, geo-technical, etc.) that the Contractor intends to utilize relating to the Project prior to signing this Agreement. The list shall include such information on the qualifications of the architect/engineers as may be requested by the Owner. Whether before the Agreement is signed or after, the Owner reserves the right to review the architect/engineers proposed and the Contractor shall not retain a architect/engineer to which the Owner has a reasonable objection. The Owner shall pay the Contractor any reasonable increased costs of obtaining the services of architect/engineers to replace those rejected by the Owner.
2. The Contractor shall provide to the Owner a list of the proposed key project personnel of the Contractor and its architect/engineers to be assigned to the Project. This list shall include such information on the professional background of each of the assigned individuals as may be requested by the Owner. Such key personnel and architect/engineers shall be satisfactory to the Owner and shall not be changed except with the consent of the Owner. The Owner’s approval of substituted personnel shall not be unreasonably withheld. The Owner shall pay the Contractor reasonable increased costs for obtaining the services of key project personnel to replace those rejected by the Owner, unless the Owner has reasonable cause from past performance or the proposed firm's qualifications to ask for the change.
3. Prior to establishing the GMP, the Contractor shall provide a list of all proposed sub-contractors and materials suppliers that the Contractor intends to solicit pricing from or utilize in the construction of the Project. The Owner reserves the right to review the proposed list and the Contractor shall not retain a sub-contractor or materials supplier to which the Owner has a reasonable objection.
Contractor Representation. 1.8.1. The Contractor shall designate a representative for this contract. At least ten working days prior to performance start date, the Contractor shall provide in writing to the COR, Contractor representative contact information. Changes in the representative, at any time after contract commencement, shall be in writing to the COR at least five working days prior to the change.
1.8.1.1. The Contractor's representative shall, at no additional cost, meet with the COR when requested by the COR to discuss any problems that the Contractor's personnel may be experiencing during the performance of this contract. Problems experienced by the Government with the Contractor's performance will be discussed and resolved. Unresolved problems will be referred to the KO for resolution.
1.8.1.2. The Contractor shall provide points of contact (POC) information for administration of the contract during normal business hours and after normal business hours. The POC for other than normal business hours will be contacted only in the event of emergencies. Accordingly, the named individual(s) shall possess sufficient corporate authority to effectively deal with emergency situations and the telephone number provided shall be functioning at all times other than normal business hours. If there are different POCs for different conditions, such as weekdays, weekends, holidays, clearly provide such information.
Contractor Representation. 21.1 The Contractor represents and warrants that it has the personnel, experience, qualifications, facilities and all other skill and resources to perform its obligations under this Contract.
Contractor Representation. A contractor representative shall be available, in person or via telephone, at all originating, enroute, turnaround and terminating points. At the originating station of a cargo mission, contractor personnel shall be available four hours prior to scheduled departure time for narrow body aircraft and six hours prior to scheduled departure time for wide body aircraft. At all enroute, turnaround and terminating points, a contractor representative shall be available at least three hours in advance of all scheduled trip departures or actual arrivals, whichever is earlier. This representative shall be responsible for providing necessary information and coordinating with Government personnel, and shall have the authority to react to and effect necessary changes.
Contractor Representation. By execution of this Agreement, the Contractor represents and warrants to the County that it has full authority to enter into this Agreement. This Agreement is a valid and enforceable obligation of the Contractor, enforceable against the Contractor in accordance with its terms except as such enforceability may be limited by applicable bankruptcy insolvency or similar laws in effect which affect creditor’s rights generally.
