Common use of Contractual Management Rights Clause in Contracts

Contractual Management Rights. The Company and each of the Shareholders acknowledge that the provisions of this Agreement, including, without limitation, this Section 3, are intended, among other things, to provide Beacon with "contractual management rights" within the meaning of the Employee Retirement Income Security Act of 1974, as amended, and the regulations promulgated thereunder.
