CONTROL AND INSPECTION. 7.1 ASMC will use commercially reasonable efforts to manufacture Wafers to conform with the Acceptance Criteria set out in Appendix C. Prior to delivery, ASMC shall perform on each lot of Wafers manufactured, the tests specified in the Acceptance Criteria. ASMC will deliver only Wafers which meet the Acceptance Criteria, unless MPS waives such obligation in accordance with the applicable Waiver Procedures specified in Appendix C, or as mutually agreed between the Parties.

CONTROL AND INSPECTION. Inspection at sea and in port Inspections at sea, in port or off port in Seychelles fishing zone on authorised Union vessels holding a fishing authorisation shall be carried out by inspectors from Seychelles who are clearly identified as being authorised to carry out fishing inspections. Before boarding, the authorised officers from Seychelles shall inform the Union vessel of their decision to carry out an inspection. The inspection shall be carried out by a reasonable number of authorised officers, who must provide proof of their identity and official position as an authorised officer before carrying out the inspection. The authorised officers from Seychelles shall only stay on board the Union vessel for the time necessary to carry out tasks linked to the inspection. They shall carry out the inspection in a way which minimises the impact on the vessel, its fishing activity and cargo. Images (photos or videos) made during inspections shall be intended for the authorities responsible for fisheries control and surveillance. They shall not be made public unless the national legislation provides otherwise. The master of the Union vessel shall allow the inspectors from Seychelles to come on board and carry out their work. At the end of each inspection, the authorised officer from Seychelles shall draw up an inspection report. The master of the Union vessel shall have the right to include their comments in the inspection report. The inspection report shall be signed by the authorised officer drawing up the report and the master of the Union vessel. The signing of the inspection report by the master shall be without prejudice to the Union vessel owner’s right of defence during any infringement procedure. The master of the Union vessel shall cooperate while the inspection procedure is being carried out. If the master refuses to sign the document, he shall specify the reasons for doing so in writing, and the inspector shall write ‘Refused to sign’ on it. The authorised officer from Seychelles shall give a copy of the inspection report to the master of the Union vessel before leaving the vessel. The Seychelles authorities shall inform the Union authorities of inspections carried out within 24 hours of their completion and of any infringements found, and send the inspection report as soon as possible. CONTROL AND INSPECTION. SUPPLIER shall establish and maintain a quality control system acceptable to SPIKA for the goods to be produced and/or services to be performed pursuant to the PO. SUPPLIER agrees to admit representatives of SPIKA and/or XXXXX’X customer to the premises of SUPPLIER and/or its agents and suppliers during regular business hours on reasonable prior notice to observe and inspect the SUPPLIER’S performance under the PO and to perform tests on the goods to be produced under the PO. SUPPLIER shall promptly notify SPIKA in writing of non-conforming goods delivered or to be delivered under the contract, including the quantity and specific identity of any impacted goods. SPIKA will determine how the non-conformit(y/ies) will affect acceptance/rejection of the goods.

When notifying its entry or exit, the Union vessel shall notify in particular: the date, time and point of passage scheduled; the quantity of all species held on board, identified by its FAO alpha 3 code and expressed in kilograms of live weight or, if necessary, the number of individual fish; the product presentation. Notification shall be given preferably by e-mail or, failing that, by fax or radio, to an e-mail address, a telephone number or a frequency communicated by The Gambia as specified in Appendix 6. The Gambia shall confirm receipt thereof immediately by return e-mail. The Gambia shall immediately inform the vessels concerned and the Union of any change to the e-mail address, telephone number or transmission frequency. Any Union vessel found to be fishing in the Gambian fishing zone without having previously notified its presence shall be considered to be a vessel fishing illegally. Inspection in port or at sea The inspection in port or while at sea in the Gambian waters of Union vessels holding a fishing authorisation shall be carried out by vessels and inspectors of The Gambia who are clearly identified as being assigned to carry out fishing checks. Before going on board, the authorised inspectors shall inform the Union vessel of their decision to carry out an inspection. The inspection shall be carried out by fisheries inspectors, who must provide proof of their identity and official position as an inspector before carrying out the inspection. The master of the vessel shall cooperate while the inspection procedure is being carried out. The authorised inspectors shall only stay on board the Union vessel for the time necessary to carry out tasks linked to the inspection. They shall carry out the inspection in a way which minimises the impact on the vessel, its fishing activity, cargo or landing or transhipping activities. The Gambia may authorise the Union to participate in the inspections as an observer. At the end of each inspection, the authorised inspectors shall draw up an inspection report. CONTROL AND INSPECTION. In order to control and ensure quality assurance, Chartered will have the right at all reasonable times and on reasonable notice, either by itself or through its auditors, to inspect the assembly lines, warehouse, facilities, equipment, materials, data, billxxxx xxx systems connected with the Works, subject always to the confidentiality undertakings in Clause 17. STATS undertakes to make available all documentation and grant Chartered all necessary access rights for Chartered or its auditors to conduct audit as permitted under this Clause 7.
CONTROL AND INSPECTION. The Departments Pavement Markings section will assign areas of work and the order in which the work must be undertaken. Upon receipt of the "award letter" the contractor must submit a list of required materials that he/she needs to order prior to the receipt of a Purchase Order, such as Epoxy paint, glass beads, and tape to insure, that the application of pavement markings begins on the scheduled date. The Department will send written confirmation of those items that the contractor is authorized to purchase. The contractor will be reimbursed for the approved materials that have been purchased, up to 20% of the total bid price of the contract, with the approval of the Engineer in charge should the contract be terminated by the State of Delaware. An authorized representative of the Department shall be assigned as Project Coordinator and shall be present during each application of the material. Payment will not be made for any work done when said representative is not present. The Department will advise the contractor of the order in which the work must be undertaken. The provisions of Failure to Pursue the Work shall apply when the contractor does not perform the work in the order required by the Department. The contractor shall begin work on the assigned units of work on or before the fifth (5th) working day (weather permitting) after notification to begin work, subject to the limitations set forth herein. Failure to begin work with the specified time shall be regarded as Failure to Pursue the Work. (See Liquidated Damages). Should it be necessary to halt the work because of incorrect or unsatisfactorily applied pavement markings under the terms of this contract, a Failure to Pursue the Work shall have occurred. (See Liquidated Damages.) Should the contractor fail to provide adequate protection to the surroundings of the work site, or should the operations be carried out in such a way as to allow or cause damage to any roadway, street, sidewalk, the property of any utility or other private or public property, the Liquidated Damages for Failing to Protect the Work Site may be assessed from the time the contractor is notified of the condition until he completes the repair. (See Liquidated Damages). Rejected pavement markings must be removed the same day that notification of rejection is given. Any rejections must be noted in the Project Coordinator's Diary. CONTROL AND INSPECTION. A) Seller shall provide and maintain a Quality Control system acceptable to Pioneer Circuits. Suppliers’ inspection system must, as a minimum, meet the requirements of ISO 9001 or MIL-I-45208. During performance of this order, Sellers Quality Control, Inspection System, and Manufacturing Processes are subject to review, verification and analysis by Pioneer Circuits, Pioneer Circuits Customer representatives, and government representatives. B) If Source Inspection is specified on the face of the purchase order seller shall notify Pioneer Circuits Buyer 72 hours in advance of when materials will be ready for inspection. C) Pioneer Circuits may require the seller to rework, replace or reimburse the purchase price of nonconforming materials. Cost of rework, replacement, inspection, transportation, and repackaging shall be at the seller’s expense. D) The buyer’s failure to inspect does not relieve Seller of any responsibility to perform to the terms of the purchase order. E) Right of Entry shall be allowed by Pioneer Circuits, Pioneer Circuits Customers, and Regulatory Agencies to determine and verify the quality of work, records, and materials at Seller’s facility or Seller’s subcontractor’s facility as applicable. F) Certificate of Conformance, Test records as applicable shall be supplied with each shipment to buyer. Unless otherwise specified Seller shall maintain all records for a minimum of 10 years from date of shipment. As 9102 or First Article Inspection Reports shall be retained for 99 years. G) The seller shall notify Pioneer Circuits Purchasing and / or Quality Assurance Departments of any nonconformance products that have or will be shipped. Acceptance of nonconforming product will require written acceptance from Pioneer Circuits Purchasing and Quality Assurance Departments.

CONTROL AND INSPECTION. The Buyer has the sole and unilateral right to choose a company or experts, if any, for the purposes of inspection of items/goods supplied by the Supplier. The Buyer will reserve the right of pre-shipment quality check through such company or experts, its own staff member, specifically authorized in this behalf to ensure agreed specifications and quality. The Buyer will reserve the right specifically designated any person in this behalf to monitor the quality of the items supplied any time before and after the definitive acceptance of the supplies through such company or expert or its own staff member. The Supplier must submit to the Buyer approved samples of selected items, to be delivered at the Sindh Agricultural and Forestry Workers Coordinating Organization (SAFWCO) Office at Disst Thatta,,Matiari & Khairrpur Sindh Pakistan before the implementation on the delivery schedule attached as Appendix C to this Agreement OR the Buyer may through its authorized person(s) can visit any place for sample approval with the consent of the Supplier. All of the items/goods to be supplied by the Supplier shall meet the specifications set forth in Appendix A of section 3.2 of Article III of this Agreement, which may be amended from time to time upon mutual agreement.
