JOINT DECLARATION ON ARTICLE 57 (FULFILMENT OF OBLIGATIONS) The Parties agree that, for the purposes of the correct interpretation and practical application of this Agreement, the term "material breach of the Agreement" in Article 57(3), in line with Article 60 (3) of the Vienna Convention on the Law of Treaties of 1969 ('Vienna Convention'), consists of:
(a) repudiation of the agreement not sanctioned by the Vienna Convention; or
(b) violation of an essential element of the Agreement, as described in Article 1(1) and (2) and Article 8.
