Common use of Control of load by an Entrant Clause in Contracts

Control of load by an Entrant. if some load is controlled by an Incumbent: If either party (the “Entrant”) seeks to control part of a Consumer's load at a Consumer’s ICP, but the other party (the “Incumbent”) has obtained the right to control part of the load at the same ICP in accordance with clause 6.1 or 6.2 (as the case may be), the Entrant may only control the part of the Consumer's load that: (a) the Consumer has agreed the Entrant may control under an agreement with the Entrant; and (b) is separable from, and not already subject to, the Incumbent’s right to control part of the Consumer's load at the ICP obtained in accordance with clause 6.1 or 6.2 (as the case may be).
