Correction of Tax Share Rent. Landlord ---------------------------- shall deliver to Tenant a report for the previous fiscal year (the "Tax Report") by May 15 of each year, or as soon as reasonably possible thereafter, setting forth (a) the actual Taxes, (b) the amount of Tax Share Rent due from Tenant, and (c) the amount of Tax Share Rent paid by Tenant. Within twenty (20) days after such delivery, Tenant shall pay to Landlord the amount due from Tenant minus the amount paid by Tenant. If the amount paid exceeds the amount due, Landlord shall apply the excess to Tenant's payments of Tax Share Rent next coming due, or refund such excess for any overpayments made during the last year of the Term within thirty (30) days of the date on which the Tax Report for such year is completed.

Correction of Tax Share Rent. As soon as reasonably possible after the end of each Fiscal Year, Landlord shall deliver to Tenant a report for such Fiscal Year (the "Tax Report") setting forth (a) the actual Taxes incurred for the applicable Fiscal Year and the Base Year, (b) the amount of Tax Share Rent due from Tenant, and (c) the amount of Tax Share Rent paid by Tenant. Within twenty (20) days after such delivery, Tenant shall pay to Landlord the amount due from Tenant minus the amount paid by Tenant. If the amount paid exceeds the amount due, Landlord shall apply any the excess as a credit against Tenant's next month's payment of Tax Share Rent, refunding any overage to Tenant.

Within twenty (20) days after such delivery, Tenant shall pay to Landlord the amount due from Tenant minus the amount paid by Tenant. If the amount paid exceeds the amount due, Landlord shall refund the excess to Tenant when it delivers the Tax Report.
Correction of Tax Share Rent. Within one hundred eighty (180) days after the end of each calendar year which falls totally or partially within the Term, Landlord shall deliver to Tenant a report for such calendar year (the “Tax Report”) setting forth (a) the actual Taxes, (b) the amount of Tax Share Rent due from Tenant, and (c) the amount of Tax Share Rent paid by Tenant. Within thirty (30) days after such delivery, Tenant shall pay to Landlord the amount due from Tenant minus the amount previously paid by Tenant. If the amount paid exceeds the amount due, Landlord shall apply any the excess as a credit against Tenant’s next monthly payment of Tax Share Rent, refunding any overage directly to Tenant.
Correction of Tax Share Rent. At any time during any fiscal year, when ---------------------------- such information becomes available, Landlord shall deliver to Tenant a report (the "Tax Report") setting forth (a) the actual Taxes for the preceding fiscal year, (b) the amount of Tax Share Rent due to Landlord for such preceding fiscal year, and (c) the amount of Tax Share Rent paid by the Tenant in and allocable to such fiscal year. On or before twenty (20) days after receipt of such report, Tenant shall pay to Landlord the amount of Tax Share Rent due for the preceding fiscal year (or a portion thereof if this Lease was not in effect for the entire fiscal year) minus any payments made for such fiscal year. If Tenant's estimated payments of Tax Share Rent exceed the amount due Landlord for the fiscal year in question, Landlord shall either refund any such amount to Tenant or apply any such amount as a credit against Tenant's other obligations under Section 2(A)(3) of this Lease.

If the amount paid exceeds the amount due, Sublandlord shall apply any excess as a credit against Subtenant's payments of Tax Share Rent next coming due.

If the amount paid exceeds the amount due, Landlord shall apply the excess to Tenant's payments of Tax Share Rent next coming due.
