Cosmetic Damage Clause Samples

The Cosmetic Damage clause defines how minor, non-structural damage that affects only the appearance of an item or property is treated under an agreement. Typically, this clause clarifies that superficial issues such as scratches, dents, or paint chips that do not impact the functionality or safety of the item are not considered material defects and may not require repair or compensation. By distinguishing between cosmetic and substantive damage, the clause helps prevent disputes over minor imperfections and ensures that parties focus on more significant issues that affect value or usability.
