Common use of Costs Includable in TI Fund Clause in Contracts

Costs Includable in TI Fund. The TI Fund shall be used solely for the payment of design, permits and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost of electrical power and other utilities used in connection with the construction of the Tenant Improvements, the cost of preparing the Space Plan, the Design Development Drawings and the TI Construction Drawings, all costs set forth in the Budget, including Landlord’s Administrative Rent, the cost of Minor Variations, Landlord’s out-of-pocket expenses, costs resulting from Tenant Delays and the cost of Changes (collectively, “TI Costs”). Except as provided in the following sentence, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A portion of TI Allowance, up to $7.00 per rentable square foot of the Premises may be used for Tenant’s voice and data cabling, security system, Tenant’s signage, the Emergency Generator and other costs reasonably acceptable to Landlord.

Costs Includable in TI Fund. The TI Fund shall be used solely for the payment of the demolition of the existing improvements in the Premises, the design, permits permits, inspection and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost of electrical power and other utilities used in connection with the construction of the Tenant Improvements, the cost of preparing the Space Plan, the Design Development Drawings Plan and the TI Construction Drawings, all costs set forth in the Budget, including Landlord’s Administrative Rent, the cost of Minor Variations, Landlord’s out-of-pocket expenses, costs resulting from Tenant Delays Delays, the cost of Changes and Tenant’s voice or data cabling and the cost of Changes Tenant’s project manager, if desired by Tenant, for the Tenant Improvements provided that the cost and scope of work for such project manager are mutually agreed to in writing by Landlord and Tenant (collectively, “TI Costs”). Except as provided in Notwithstanding anything to the following sentencecontrary contained herein, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A portion of TI Allowance, up to $7.00 per rentable square foot of the Premises may be used for Tenant’s voice and data cabling, security system, Tenant’s signage, the Emergency Generator and other costs reasonably acceptable to Landlord.

Notwithstanding anything to the contrary contained herein, except for the Soft Cost Allowance, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. The TI Fund shall be used solely for the payment of design, permits and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost of electrical power and other utilities used in connection with the construction of the Tenant Improvements, the cost of preparing the Space Plan, the Design Development Drawings Plan and the TI Construction Drawings, the cost of any commissioning services for the Tenant Improvements elected by Landlord to be performed, all costs set forth in the Budget, including Landlord’s 's Administrative Rent, the cost of Minor Variations, Landlord’s out-of-pocket expenses, costs resulting from Tenant Delays and the cost of Changes (collectively, “"TI Costs”"). Except as provided in Notwithstanding anything to the following sentencecontrary contained herein, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s 's voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A portion of Notwithstanding anything to the contrary contained herein, Landlord shall, at Landlord’s sole cost and expense (not payable from the TI Allowance, up Fund or otherwise chargeable to $7.00 per rentable square foot Tenant) acquire the fume hoods located within the Premises as of the Premises may be used for Tenant’s voice and data cabling, security system, Tenant’s signage, date of the Emergency Generator and other costs reasonably acceptable to LandlordLease from the existing tenant at the Premises.

Costs Includable in TI Fund. The TI Fund shall be used solely for the payment of design, permits and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost of electrical power and other utilities used in connection with the construction of the Tenant ImprovementsImprovements (and Landlord agrees to equitably allocate the cost of electrical power and other utilities between Landlord and Tenant based on reasonable estimates of the usage of such electrical power and other utilities by the parties in connection with their respective construction activities at the Project), the cost of preparing the Space Plan, the TI Design Development Drawings and the TI Construction Drawings, all costs set forth in the Budget, including the Construction Management Fee, Landlord’s Administrative Rent, the cost of Minor Variations, Landlord’s out-of-pocket expenses, costs resulting from Tenant Delays and the cost of Changes (collectively, “TI Costs”). A portion of TI Allowance, up to $10.00 per rentable square foot of the Premises may be used for Tenant’s voice and data cabling, fixtures and other costs reasonably acceptable to Landlord. Except as provided in the following immediately preceding sentence, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A Notwithstanding anything to the contrary contained herein, a portion of the TI Allowance, up to $7.00 per rentable square foot of the Premises may Allowance shall be used to reimburse Landlord for any costs and expenses incurred by Landlord under that certain Indemnification Agreement between Landlord and Tenant’s voice and data cabling, security system, Tenant’s signage, the Emergency Generator and other costs reasonably acceptable to Landlord.
