Common use of Costs Includable in TI Fund Clause in Contracts

Costs Includable in TI Fund. The TI Fund shall be used solely for the payment of design, permits and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost of electrical power and other utilities used in connection with the construction of the Tenant Improvements, the cost of preparing the Space Plan, the Design Development Drawings and the TI Construction Drawings, all costs set forth in the Budget, including Landlord’s Administrative Rent, the cost of Minor Variations, Landlord’s out-of-pocket expenses, costs resulting from Tenant Delays and the cost of Changes (collectively, “TI Costs”). Except as provided in the following sentence, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A portion of TI Allowance, up to $7.00 per rentable square foot of the Premises may be used for Tenant’s voice and data cabling, security system, Tenant’s signage, the Emergency Generator and other costs reasonably acceptable to Landlord.

The TI Fund shall be used solely for the payment of the demolition of the existing improvements in the Premises, the design, permits permits, inspection and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost of electrical power and other utilities used in connection with the construction of the Tenant Improvements, the cost of preparing the Space Plan, the Design Development Drawings Plan and the TI Construction Drawings, all costs set forth in the Budget, including Landlord’s Administrative Rent, the cost of Minor Variations, Landlord’s out-of-pocket expenses, costs resulting from Tenant Delays Delays, the cost of Changes and Tenant’s voice or data cabling and the cost of Changes Tenant’s project manager, if desired by Tenant, for the Tenant Improvements provided that the cost and scope of work for such project manager are mutually agreed to in writing by Landlord and Tenant (collectively, “TI Costs”). The TI Fund shall be used solely for the payment of design, permits permits, and construction costs in connection with the construction of the Tenant Improvements, including, without limitation, the cost to assess the vapor and moisture of the flooring of the 8000 VMR Premises and any necessary repairs thereto, the cost of electrical power and other utilities used in connection with the construction of the Tenant Improvements, the cost of preparing the Space Planspace plans/test fits, the TI Design Development Drawings Drawings, and the TI Construction Drawings, all costs set forth in the Budget, including Landlord’s Administrative Rent, the cost of Minor VariationsChanges, Landlord’s outdemolition costs, “soft” costs for fees of architects and other professionals engaged in connection with the perform a nee of the Tenant Improvements, and equipment installed within the 8000 VMR Premises (which equipment shall be surrendered to Landlord at the expiration or earlier termination of the Term except for such equipment that Tenant has to the right to remove in accordance with the terms and conditions of Section 12 of the Lease), and built-ofin lockers and built-pocket expenses, costs resulting from Tenant Delays and the cost of Changes in file cabinets (collectively, “TI Costs”). Except as provided in Notwithstanding anything to the following sentencecontrary contained herein, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A ; provided, however, that, to the extent that any portion of the TI AllowanceAllowance remains unused following the payment in full for the cost of the Tenant Improvements reflected in the Construction Drawings, Tenant may utilize up to $7.00 per rentable square foot of the Premises may be used TI Allowance for Tenant’s voice and data network cabling, security system, Tenant’s signage, the Emergency Generator fixtures and other costs and expenses reasonably acceptable to Landlord, which items shall be the property of Landlord and shall not be removed from the Premises by Tenant during the Term of the Lease or at the expiration or earlier termination of the Lease unless replaced by items of equal or better quality.

Except as provided in Notwithstanding anything to the following sentencecontrary contained herein, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s 's voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A portion of Notwithstanding anything to the contrary contained herein, Landlord shall, at Landlord’s sole cost and expense (not payable from the TI Allowance, up Fund or otherwise chargeable to $7.00 per rentable square foot Tenant) acquire the fume hoods located within the Premises as of the Premises may be used for Tenant’s voice and data cabling, security system, Tenant’s signage, date of the Emergency Generator and other costs reasonably acceptable to LandlordLease from the existing tenant at the Premises.

Notwithstanding anything to the contrary contained herein, except for the Soft Cost Allowance, the TI Fund shall not be used to purchase any furniture, personal property or other non-Building system materials or equipment, including, but not limited to, Tenant’s voice or data cabling, non-ducted biological safety cabinets and other scientific equipment not incorporated into the Tenant Improvements. A portion of TI Allowance, up to $7.00 per rentable square foot of the Premises may be used for Tenant’s voice and data cabling, security system, Tenant’s signage, the Emergency Generator and other costs reasonably acceptable to Landlord.
