Costs Not Agency Costs. Costs incurred by the Agent which (i) are not attributable to the activities, duties and functions to be performed by the Agent pursuant to Section 7 of this Agreement and (ii) have not been included in SCPPA’s annual budget or otherwise approved by SCPPA under this Agreement shall not be Agency Costs.
