Common use of Costs of Suspension Clause in Contracts

Costs of Suspension. The Independent Certifier will: (a) subject to the Independent Certifier complying with Section 8, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(b) valued as a Functions Variation under Section 8; and (b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a).

Costs of Suspension. (a) The Independent Certifier will: (ai) subject to the Independent Certifier complying with Section 8Article 9, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(b6.1(a)(ii) valued as a Functions Certification Services Variation under Section 89; and (bii) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a6.1(a)(i).

Costs of Suspension. F2.1 The Independent Certifier will: (a) subject to the Independent Certifier complying with Section 8I, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(bF1.1(b) of this Independent Certifier Agreement valued as a Functions Certification Services Variation under Section 8I; and (b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a)F1.1(a)of this Independent Certifier Agreement.

The Independent Certifier will:shall:‌ (a) subject to the Independent Certifier complying with Section 88.1 [Notice of Variation], be entitled to recover the any extra costs incurred by the Independent Certifier by reason of a suspension directed under pursuant to Section 5.1(b) ), such costs to be valued as a Functions Variation under Section 88.1 [Notice of Variation] and Section 8.2 [No Adjustment]; and (b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under pursuant to Section 5.1(a).

The Independent Certifier will: (a) subject to the Independent Certifier complying with Section 89, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(b6.1(b) valued as a Functions Variation under Section 89; and (b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a6.1(a).

The Independent Certifier will: (a) subject to the Independent Certifier complying with Section 8I, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(bF1.1(b) of this Independent Certifier Agreement valued as a Functions Certification Services Variation under Section 8I; and (b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a)F1.1(a)of this Independent Certifier Agreement.
