Common use of Costs on Default Clause in Contracts

Costs on Default. Any party who defaults in the payment of any moneys or in the performance of any obligations under this Licence will pay to the other party who exercises or attempts to exercise any right power, authority or remedy conferred on that party under or by virtue of this Licence or otherwise the fair and reasonable costs thereof whether or not any proceedings in any court or tribunal are taken to protect any such right, power, authority or remedy.
