Common use of Covenant Breaches Clause in Contracts

Covenant Breaches. Any Loan Party shall (i) fail to perform or observe any covenant contained in Sections 5.01 (with respect to the existence of the Borrower) and 5.07(a) and Article VI or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days after the earlier to occur of any Loan Party obtaining knowledge thereof or receiving notice thereof from the Administrative Agent (including at the request of any Lender);

Covenant Breaches. Any Loan Party or any Restricted Subsidiary thereof shall fail to (i) fail to perform or observe any covenant contained in Sections 5.01 Section 5.02(a), Section 5.03 (with respect to the existence of either Holdings’ or the Borrower) and 5.07(a) and ’s existence), Section 5.06(i), Section 5.09, or Article VI of this Agreement or (ii) fail to perform or observe any other term or covenant set forth in this Agreement or in any other Loan Document which is not covered by clause (i) above or any other provision of this Section 7.01 if such failure shall remain unremedied for 30 days after the earlier to occur occurrence of any Loan Party obtaining knowledge thereof such breach or receiving notice thereof from the Administrative Agent (including at the request of any Lender)failure;
