Covenant Independent. Each restrictive covenant set forth in this Agreement shall be construed as a covenant independent of any other covenant or provision of this Agreement or any other agreement which the Seller or the Xxxxxxxx may have, whether fully performed or executory, and the existence of any claim or cause of action by the Seller against the Buyer, whether predicated upon another covenant or provision of this Agreement or otherwise, shall not constitute a defense to the enforcement by the Buyer of such restrictive covenant.
