Common use of Covenant Not to Solicit Employees Clause in Contracts

Covenant Not to Solicit Employees. During the Employment Period and the Restrictive Period, the Executive shall not directly or indirectly, individually or on behalf of any other Person, whether as principal, agent, stockholder, employee, consultant, representative or in any other capacity: (a) recruit, solicit or encourage any person to leave the employ of the Company or any of its Subsidiaries; or (b) hire any employee of the Company or any of its Subsidiaries as a regular employee, consultant, independent contractor or otherwise.

Covenant Not to Solicit Employees. During the Employment Period and the Restrictive Period, the Executive Employee shall not directly or indirectly, individually or on behalf of any other Person, whether as principal, agent, stockholder, employee, consultant, representative or in any other capacity: (a) recruit, solicit or encourage any person to leave the employ of the Company or any of its Subsidiaries; or (b) hire any employee of the Company or any of its Subsidiaries as a regular employee, consultant, independent contractor or otherwise.

During Subject to Section 7.4 below, during Executive's employment with the Employment Period Company and from the Termination Date through the applicable Restrictive Period, the Executive shall not directly or indirectly, individually or on behalf of any other Personperson or entity, whether as principal, agent, stockholder, employee, consultant, representative or in any other capacity: (a) recruit, solicit or encourage any person to leave the employ of the Company or any of its Subsidiariessubsidiaries; or (b) hire any employee of the Company or any of its Subsidiaries subsidiaries as a regular employee, consultant, independent contractor or otherwise.

During Subject to Section 7.4 below, during Executive's employment with the Employment Company and from the Termination Date through the applicable Restrictive Period and the Restrictive Period, the Executive shall not directly or indirectly, individually or on behalf of any other Personperson or entity, whether as principal, agent, stockholder, employee, consultant, representative or in any other capacity: (a) 7.2.1 recruit, solicit or encourage any person to leave the employ of the Company or any of its Subsidiariessubsidiaries; or (b) 7.2.2 hire any employee of the Company or any of its Subsidiaries subsidiaries as a regular employee, consultant, independent contractor or otherwise.
