Common use of Covenant Not to Xxx Plaintiffs’ Releasees Clause in Contracts

Covenant Not to Xxx Plaintiffs’ Releasees. Subject to Sections 4.6 and 14, upon the Effective Date of Settlement, Defendants covenant and agree (a) not to file against any Plaintiffs’ Releasees any Claim released under Section 4.2; and (b) that the foregoing covenant and agreement shall be a complete defense to any such claims against any of the Plaintiffs’ Releasees.
