Covered Projects. The Administrator may contract for project management oversight services when the following two conditions apply:
Covered Projects. Projects subject to this Article 18 shall consist of projects whose cumulative value for all concrete items of work/portion of the project is $250,000.00 or less. However, on certain projects which have a cumulative value for all concrete items of work/portion of the project that is more than $250,000.00 and are deemed to be advantageous by both parties to do so and with five (5) days notice to the Union and followed by written notice of the Employer’s intentions to bid such project, said project may be within the scope and intent of this Article 18. This Paragraph 18.2 may be modified by mutual consent of the parties.
Covered Projects. Each Covered Project has (i) except with respect to the permits and authorizations set forth on Schedule 3.19, all federal, state and local permits and authorizations necessary to construct and operate the Covered Project in accordance with such Covered Project’s PPA; (ii) a fully executed PPA that is in good standing, has not lapsed and the counterparties to the PPA have not given written or verbal notice that there is a default under the PPA or that it has terminated or will terminate such PPA; (iii) a fully executed site agreement (or an adequate site license set forth in the applicable PPA) that provides adequate land and facilities to build and operate the Covered Project for the life of the PPA, and the counterparties to the site agreement have not given written or verbal notice that there is a default under the site agreement or that it has terminated or will terminate such site agreement; (iv) except with respect to the permits and authorizations set forth on Schedule 3.19, all federal, state, local and municipal permits and authorizations necessary to interconnect the Covered Project to an electric grid or electric distribution system to deliver the full amount of electricity under the PPA and, the counterparties to such interconnect agreements or arrangements have not given written or verbal notice that there is a default under such interconnect agreement or that it has terminated or will terminate such interconnect agreement; and (v) except with respect to the permits and authorizations set forth on Schedule 3.19, all other agreements, permits and authorizations necessary to construct and operate the Covered Project for the life of the PPA.
Covered Projects. Projects subject to this Article 12 shall consist of any and all projects in Jasper, Newton, Xxxxx and Pulaski counties. This may also apply to others that are deemed to be advantageous by both parties to do so and with five (5) days notice to the Union and followed by written notice of the Employer’s intentions to bid such project, said project may be within the scope and intent of this Article 12. This Paragraph 12.2 may be modified by mutual consent of the parties.
Covered Projects. “Covered Projects” shall refer to those habitat restoration projects as to which the Parties collaborate on project design and establishment of Forecast Settlement Credit Value pursuant to the terms of this MOA.
Covered Projects. Except as provided otherwise herein, this Policy applies to all projects contained in the Public Infrastructure Programs Series List, awarded by the Board, and covered by the DPW-PLA. The Board may designate additional projects for coverage under the Policy and DPW-PLA based on specific findings that coverage will advance the City’s legitimate proprietary and policy interests and promote the public interest in assuring completion of the project in question in a safe and cost-effective manner while minimizing or negating any adverse impact to the public welfare.
Covered Projects. Projects subject to this Article 17 shall consist of projects whose cumulative value for all concrete items of work/portion of a project is $250,000.00 or less. However, on certain projects which have a cumulative value for all concrete items of work/portion of a project that is more than $250,000.00 and are deemed to be advantageous by both parties to do so and with five (5) days notice to the Union and followed by written notice of the Employer’s intentions to bid such project, said project may be within the scope and intent of this Article 17. This Paragraph 17.2 may be modified by mutual consent of the parties.17.3 The Union may cancel this Article 17 as to a particular Employer if in its sole judgment the Union believes the said Employer has violated or abused this Article 17. Provided further, should a difference of opinion arise pertaining to work covered by this Article 17, the difference of opinion shall be settled in accordance with Article 10.
Covered Projects. Covered Projects shall refer to those projects as to which the Parties collaborate on project design and establishment of Forecast Settlement Credit Value pursuant to the terms of this MOA.
Covered Projects. (a) DASNY, prior to soliciting any bids or proposals and commencing work on any Project, shall cause to be performed an analysis (which analysis may pertain to a specific Project or type or group of Projects) establishing whether adherence to the terms of the Applicable Project Labor Agreement will result in the lowest reasonable cost for the Project based upon one or more of the factors enumerated in the fourth Recital of this MOU. In furtherance of this requirement, DASNY shall: (i) cause one or more such analyses to be undertaken with respect to the Projects identified on Attachment "C" to this MOU and (ii) with respect to any other Project, may, in its sole discretion, either rely on the analyses obtained pursuant to clause (i) of this sentence or obtain a separate analysis• to satisfy the requirements of paragraph (b)(2) ofthis Section for such other Project.
Covered Projects. The CITY will ensure that all requirements specified in Sections 4 through 6 of the RPV NCCP Subarea Plan are included as enforceable conditions of the CITY's approvals of Covered Projects. If the CITY identifies site specific physical conditions including, but not limited to geology, slope, or location of infrastructure that make goals, criteria or other requirements in the RPV NCCP Subarea Plan infeasible, but the project could be constructed without compromising conservation of species and habitats pursuant to the Subarea Plan, the CITY may approve a deviation from the RPV NCCP Subarea Plan requirements for the project with the concurrence of USFW S and CDFG. The deviation shall be the minimum necessary to afford relief and accommodate the Covered Project.
