Common use of Covered Provider Clause in Contracts

Covered Provider. A “Covered Provider” is (1) a non-United States Provider that receives (other than pursuant to a direct contract or agreement with MCC) USD $300,000 or more of MCC Funding in any MCA-Georgia fiscal year or any other non-United States person or entity that receives (directly or indirectly) USD $300,000 or more of MCC Funding from any Provider in such other party’s fiscal year or (2) any United States Provider that receives (other than pursuant to a direct contract or agreement with MCC) USD $500,000 or more of MCC Funding in any MCA-Georgia fiscal year or any other United States person or entity that receives(directly or indirectly) USD $500,000 or more of MCC Funding from any provider in any such fiscal year.

A “Covered Provider” is (1A) a any non-United States Provider that receives (other than pursuant to a direct contract or agreement with MCC) USD $300,000 or more of MCC Funding in any MCA-Georgia Honduras fiscal year or any other non-United States U.S. person or entity that receives (receives, directly or indirectly) , USD $300,000 or more of MCC Funding from any Provider in such other party’s fiscal year or (2B) any United States Provider that receives (other than pursuant to a direct contract or agreement with MCC) USD $500,000 or more of MCC Funding in any MCA-Georgia Honduras fiscal year or any other United States person or entity that receives(directly receives, directly or indirectly) , USD $500,000 or more of MCC Funding from any provider Provider in any such fiscal year.
