Credit Payment. The payment by Borrowers, as and when due and payable, of all amounts from time to time owing by Borrowers, or any of them, under or with respect to the Financing Agreement, the Notes and the other Obligation Documents or any other instrument now or hereafter delivered in connection with or as security for the Financing Agreement, the Notes or the other Obligation Documents or any part thereof.
Credit Payment. 5.1 At the end of the term of this Letter Agreement, Buyer's total compensation credit calculated under Article 4.2 above, and BRAD's total incentive credit calculated in Article 4.3 above, shall be compared by the following formula to determine if a credit is due to Buyer. Credit Payment. Buyer shall remit payment to Seller in U.S. currency in accordance with the payment term designated in the applicable invoice or Contract, or its equivalent in Mexican pesos in accordance with the official exchange rate published in Mexican Federal Official Gazette. If credit is extended, Seller at any time may revoke credit or modify the terms and conditions of future extensions of credit. Xxxxx agrees to pay all invoices within the terms stated on such invoice or Contract and agrees to all terms contained in invoices and Contract supplied by Seller, as may be amended from time to time. In the event payment is not timely made, Xxxxx also agrees to pay a time-price difference charge (service charge) of the lesser of 1 ½ % per month (18 % per annum) or the maximum lawful rate on all overdue amounts commencing the day after the due date and to pay all collection costs incurred by Seller in enforcement of the Contract, including court costs, actual reasonable attorney’s fees, and collection agency fees, within the standards of the industry, but not less than 25% of the unpaid amount of principal plus any accumulated service charge, all without relief from valuation and appraisement laws. In addition, in the event Buyer fails to make timely payment, any or all future shipments of Product by Seller to Buyer may be withheld by Seller without waiving any right, power, remedy, or privilege of Seller. Buyer will also be responsible for any charges applied because of any check, debit, or electronic transfer not honored. No remedy of Seller against Buyer is intended to be exclusive, but each remedy of Seller shall to the maximum extent allowed by law be cumulative and in addition to any other remedy referred to herein or otherwise available to Seller. The exercise or beginning to exercise by Seller of any one or more remedies shall not preclude the simultaneous or later exercise by Xxxxxx of other remedies. All remedies of Seller shall, to the maximum extent allowed by law, survive any and all terminations of any agreements between the Parties. To the maximum extent allowed by law, no delay or failure on the part of Seller in exercising any right, remedy, power, or privilege of Seller shall operate as a waiver thereof.
Credit Payment. 9.1 You will be ultimately accountable for all monies due under this Agreement even if control of the Client is lost during the period of insurance. 9.2 In executing this Agreement You agree to pay all monies owed to Us for the placement of insurance policies. This will be detailed in accordance with relevant debit notes or statement of accounts, within 30 calendar days of inception or within other timescales if specifically agreed in writing prior to inception of the arranged insurance policies whether the premium has been received by You or not. 9.3 If You fail to make a payment within the specified timescales We, under the terms of this Agreement, have the right but not the obligation to lapse or cancel the relevant policy or policies. We reserve the right to charge You interest on unpaid sums at the rate applicable at the time in accordance with the Late Payments of Commercial Debts (interest) Xxx 0000. 9.4 No allowance will be made for: 9.4.1 Any delay caused by deficiencies within Your accounting system. 9.4.2 Your inability to obtain monies from the Client. 9.4.3 Any allowances made by you for credit arrangements on behalf of the Client and you will remain liable for the payment of the full premium in accordance with the terms of this Agreement 9.5 We reserve the right during the currency of the Agreement to conduct credit searches against You or relevant organisations or Your Directors or any Director's Partner.

Credit due Buyer = EQb - YQs Qb and Qs shall have the same meaning as used in Article 4.2 and Article 4.3 above. 5.2 Disclosure Regarding Confidential Information: Portions of pages 55 and 60 of the Purchase Agreement and portions of pages 2-5, 7-9, 14, 19, 20, 24-27, 29, 30, 43, 44, 48, 50, 51, 53, 56 and 59 of the Supplements and Schedules thereto of the Purchase Agreement have been omitted from this Exhibit 10.20 to the Annual Report on Form 10-K filed with the Securities and Exchange Commission (the "Commission") by SkyWest, Inc. The omitted portions, which are the subject of an application for confidential treatment and have been filed separately with the Commission, are identified in this exhibit by the placement of this legend. 5.3 If the credit due to Buyer is negative, Buyer will be under no obligation to compensate Bombardier, nor shall Bombardier owe any compensation to Buyer.

Credit Payment. You agree to promptly complete and submit to us our form(s) of Rental and/or credit application(s) if and when requested by FTR. FTR retains the right, at its sole option, to refuse to rent or sell to any current or prospective Customer at any time for any reason or for no reason (subject to applicable laws, rules, and regulations). Without limiting the generality of the foregoing statement, if you do not maintain a pre-approved charge account with FTR, you may be required to pre-pay all Rent and other anticipated charges accruing hereunder prior to each applicable Commencement Date, unless otherwise agreed in writing by FTR on a case-by-case basis.
