Credit Union Responsibilities. (i) The Credit Union shall maintain the strictest level of confidentiality regarding the nonpublic personal information of the members and non-member consumers of every other participating credit union, and specifically agrees to implement appropriate measures designed to meet the objectives of the ▇▇▇▇▇-▇▇▇▇▇-▇▇▇▇▇▇ Act of 1999 as “Non-public Personal Information” or “NPI,” as well as Parts 716 and 748 of the NCUA Rules and Regulations, and Part 682 of the Rules issued by the Federal Trade Commission. (ii) The Credit Union agrees that it will not disclose or use any nonpublic personal information it obtains under the Lucky Savers program to any third party other than to carry out the purposes for which the information is disclosed by any other credit union in the ordinary course of business pursuant to this Agreement. (iii) The Credit Union agrees to implement policies and procedures designed to protect against unauthorized or unintentional disposal of consumer information in accordance with the provisions specified in Title V of the ▇▇▇▇▇-▇▇▇▇▇-▇▇▇▇▇▇ Act, Parts 716 and 748 of the NCUA Rules and Regulations, and Part 682 of the Rules issued by the Federal Trade Commission, including any amendments.
Credit Union Responsibilities. We will not be responsible for any acts or omissions by the financial institution or other provider of any Third Party Account, including without limitation any modification, interruption or discontinuance of any Third Party Account by such provider. You agree that the Credit Union shall not be liable for any costs, fees, losses or damages of any kind incurred as a result of (1) access to the third party accounts by us or our service provider; (2) our retrieval of or inability to retrieve information from the third party accounts; (3) any inaccuracy, incompleteness or misinformation contained in content retrieved from the third party accounts and (4) any charges imposed by the provider of any third party account.

(iii) The Credit Union agrees to implement policies and procedures designed to protect against unauthorized or unintentional disposal of consumer information in accordance with the provisions specified in Title V of the ▇▇▇▇▇-▇▇▇▇▇-▇▇▇▇▇▇ Act, Part 748 of the NCUA Rules and Regulations, and Part 682 of the Rules issued by the Federal Trade Commission, including any amendments.
Credit Union Responsibilities. Credit Union shall: (i) be solely responsible for its own expenses, debts, accounts, obligations, and liabilities arising from its card program; (ii) be solely responsible for execution and termination of cardholder agreements with cardholders on accounts Credit Union establishes through CSCU’s BINs or ICAs; (iii) be the sole owner of any card account it may open through a CSCU BIN or ICA, and may assign, sell or otherwise transfer those card accounts as it sees fit; (iv) have the right to maintain its own identity in connection with offering card accounts or services to its members; (v) be solely responsible for billing and collecting any amounts due on any card account; (vi) be solely responsible for any losses, including fraud and credit losses, associated with, or arising out of, its use of CSCU’s BINs or ICAs to issue card accounts (it being understood and agreed that the obligations of Credit Union hereunder are separate and distinct from the obligations of any other CSCU member, and no member of CSCU (including Credit Union) shall have any liability for amounts due from any other member); (vii) pay to CSCU all dues, fees, assessments, security deposits, fines and penalties assessed by Visa or MasterCard in connection with Credit Union’s accounts on CSCU BINs or ICAs at the same rate that Credit Union would pay if it were paying VISA or MasterCard directly; (viii) maintain the financial condition required by then current VISA and/or MasterCard bylaws and regulations; (ix) comply with all applicable Visa and MasterCard by-laws, rules and regulations; (x) comply with all applicable laws and their implementing regulations, including the USA Patriot Act; (xi) provide CSCU upon request copies of reports (such as the 5300 or 5300S reports) Credit Union is required to file with its regulators; (xii) notify its surety company of the existence of this Membership Agreement, and (xiii) retain in good standing its membership in CSCU.
Credit Union Responsibilities. Credit Union will provide access to the processing equipment and software for the Services through the Mobile Application. Credit Union will also provide maintenance and support for the Services to ensure the accurate delivery of the Services, including, but not limited to:

(i) Adhere to the Implementation Guide, listed as Exhibit A, attached hereto. (ii) Adopt and offer a Share Certificate/Certificate of Deposit account, including base savings product, name, APY offered, prize drawing structure including participation in the monthly and quarterly prize drawings, and use of provided or credit union-generated marketing plan and materials, and administration of a participant survey for research and informational purposes. (iii) Require that the sole consideration for entries into the Lucky Savers program will be the deposit of at least $25.00 (twenty five dollars) into a Lucky Savers Share Certificate account. (iv) Solely to the extent of the Credit Union’s involvement the conduct of any quarterly prize raffles, as well as any monthly prize raffles, administered by TruLync under the Lucky Savers program to be conducted so that each entry has an equal chance of winning. (v) Inform each participating member that the credit union will disclose the social security number of the account holder to TruLync in a safe, secure, encrypted manner for the sole purpose of creating a unique identifier for each participant. All social security number data will be destroyed at the end of each drawing period and will not be kept by TruLync or transferred to any third party.
