Common use of Cultural Competency Clause in Contracts

Cultural Competency. In accordance with 42 CFR 438.206, the Contractor shall participate in the State’s efforts to promote the delivery of services in a culturally competent manner to all members, including those with limited English proficiency and diverse cultural and ethnic backgrounds. Per 42 CFR 438.204, at the time of enrollment with the Contractor, the State shall provide the race, ethnicity and primary language of each member. This information shall be utilized by the Contractor to ensure the delivery of care in a culturally competent manner. The Contractor shall incorporate the Office of Minority Health’s National Standards on Culturally and Linguistically Appropriate Services (CLAS) into the provision of health care services for its members.
