Customer to Indemnify. The Customer indemnifies the Scheme Owner against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by or brought or made or recovered against the Scheme Owner:
(a) in connection with the quality of water within the Distribution Network and the DOL Area where an act or omission of the Customer (whether or not under this Agreement) has affected the quality of such water;
(b) by any person to whom the Customer has supplied water or who the Customer has allowed to take water.
Customer to Indemnify. The Customer must indemnify SunWater against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by or brought or made or recovered against SunWater:
(a) in connection with the quality of water within the SunWater Works and the Regulated Area where an act or omission of the Customer (whether or not under this Agreement) has affected the quality of such water;
(b) by any person to whom the Customer has supplied water or who the Customer has allowed to take water.
Customer to Indemnify. The Customer must indemnify ROL Holder against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by or brought or made or recovered against ROL Holder:
(a) in connection with the quality of water within the ROL Holder Works and the Regulated Area where an act or omission of the Customer (whether or not under this Agreement) has affected the quality of such water;
(b) by any person to whom the Customer has supplied water or who the Customer has allowed to take water.
Customer to Indemnify. The Customer must indemnify Fitzroy River Water against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by or brought or made or recovered against Fitzroy River Water:
(a) in connection with the quality of water within the Fitzroy River Barrage and the Regulated Area where an act or omission of the Customer (whether or not under this Agreement) has affected the quality of such water;
(b) by any person to whom the Customer has supplied water or who the Customer has allowed to take water.
Customer to Indemnify. Customer shall indemnify and hold harmless Provider and its officers, directors, affiliates, employees, agents, and contractors from all claims, losses, expenses, fees, including but not limited to court costs and attorney fees, costs, and judgments that may be imposed on, incurred by, or asserted against Provider, without regard to cause or causes arising in connection with this Agreement and with the provision or use of the Services by Customer, or its affiliates, employees, agents and contractors, invitees or performance by those entities under this Agreement, including but in no way limited to, a breach by Customer of its representations and warranties.
Customer to Indemnify. The Customer indemnifies Seqwater against all actions, suits, claims, demands, causes of action, costs and expenses (including any existing unsatisfied costs orders), legal, equitable, under statute and otherwise, and all other liabilities of any nature (whether or not the parties were or could have been aware of them) incurred or suffered by or brought or made or recovered against Seqwater arising out of or in connection with:
(a) the quality of water within Seqwater Property and the Regulated Area;
(b) any person to whom the Customer has supplied water or who the Customer has allowed to take water.
Customer to Indemnify. The Customer indemnifies Seqwater against all actions, suits, claims, demands, causes of action, costs and expenses (including any existing unsatisfied costs orders), legal, equitable, under statute and otherwise, and all other liabilities of any nature (whether or not the parties were or could have been aware of them) incurred or suffered by or brought or made or recovered against Seqwater arising out of or in connection with: Doc no. (a) the quality of water within Seqwater Property, the aquifer and the Regulated Area;
(b) any person to whom the Customer has supplied water or who the Customer has allowed to take water.
Customer to Indemnify. The Customer indemnifies Sunwater and its agents, officers, employees, managers and contractors against all loss suffered or incurred by Sunwater and its agents, officers, employees, managers and contractors in relation to any Claim or Claims:
(a) made by third parties arising out of, in relation to or in connection with, the Customer's breach of this Agreement, negligence or other wrongful or unlawful conduct, save and to the extent the loss is contributed to by Sunwater; and
(b) made by any person arising out of, in relation to or in connection with the supply of, making available of or receipt of water which has been transported by Sunwater to or for the Customer under or in relation to this Agreement, including any Claims in relation to the quality, suitability or fitness for purpose (whether or not Sunwater is aware of the Customer's purpose or purposes) of the water
Customer to Indemnify. (a) The Customer indemnifies Sunwater and its agents, officers, employees, managers and contractors against all loss, costs and expenses suffered or incurred by Sunwater and its agents, officers, employees, managers and contractors arising out of, in relation to or in connection with the Customer's breach of this Agreement, negligence or other wrongful or unlawful conduct, save to the extent the loss is caused or contributed by any negligent, wilful or wrongful act or omission of Sunwater.
Customer to Indemnify to fully indemnify:
(a) JEI for any loss or damage to the hireage whatsoever while the hireage is under the care of the Customer (including upon delivery or installation); and
(b) not to hold JEI liable for any loss or damage caused to the Customer or to any other third party and to fully indemnify JEI in respect of any claim by a Council or local authority or any other third party against JEI which may result from the Customer’s actions, omissions or negligence (or that of their employees or agents);
