Common use of Damage or Destruction of Property Clause in Contracts

Damage or Destruction of Property. 1. Employees shall not be held responsible for loss of Board property when such loss is not the fault of the employee. This does not exonerate the employee from responsibility for Board property in his/her charge. 2. The Board will reimburse employees, in an amount not to exceed a total of $100 in any school year, for loss or damages or destruction, while on duty in a school, district or Central Board office, of personal property of a kind normally worn to or brought into a school when the employee has not been negligent, to the extent that such loss is not covered by insurance. The term "personal property" shall not include cash. The terms "loss," "damage" and "destruction" shall not cover the effects of normal wear and tear and use.

Council members shall not be held responsible for loss within the school of Board school property or children's property when such loss is not the fault of the employee. This does not exonerate the employee from responsibility for Board property in his/her chargeCouncil member. 2. B. The Board will reimburse employees, Council members in an amount not to exceed a total of $100 750.00 per incident, with a maximum of $1,200.00 in any school year of the contract year, for loss or damages damage or destruction, while on duty in a the school, district or Central Board office, of personal property of a kind normally worn to or brought into a school school, when the employee Council member has not been negligent, negligent and to the extent that such loss is not covered by insurance. The term "personal property" shall not include cash. The terms "loss," ", "damage" and "destruction" shall not cover the effects of normal wear and tear and use. C. Satisfactory proof of damage or destruction while in the course of Board related employment must be submitted to the Board.
