Extensive Damage. In the event damages as referenced in Section .01 of this Article are so extensive as to render all or a significant portion of the Premises untenable, but capable of being repaired within 120 days, Company will give Authority immediate notice thereof, and Authority will make the repairs with due diligence, at its own cost and expense.
Extensive Damage. In the event damages as referenced in Section 19.01 are so extensive as to render all or a significant portion of the Airline Premises untenable, but capable of being repaired within 120 days, the Airline will give the Authority immediate notice thereof, and the Authority will make the repairs with due diligence, at its own cost and expense.
Extensive Damage. If the damages referred to in Section 10.01 shall be so extensive as to render the Premises untenantable, but capable of being repaired in thirty (30) days, the same shall be repaired with due diligence by the Authority at its own cost and expense, subject to the limitations of Section 10.04. An appropriate portion of the concession fee shall xxxxx unless the damage is caused by the act or omission of the Contractor, its subcontractors, agents or employees. If the damage is caused by the act or omission of the Contractor, its subcontractors, agents or employees, to the extent that such damage or destruction is not covered by insurance, the Contractor shall be responsible for reimbursing the Authority for the cost and expense incurred in such repair.
Extensive Damage. 14.3.1 If the damage shall be so extensive as to render the Concession Facility unusable, but capable of being repaired in thirty (30) days, and the Director elects to repair the Facility, the City shall proceed with due diligence to do so at its own cost and expense, and, notwithstanding Section 17.26, the fees payable herein as to such Facility shall be paid to the time of such damage and thereafter cease until such time as the Facility is fully repaired or restored; provided, however, that if the damage is caused by an act or omission of the Concessionaire, its agents, employees, suppliers, Subcontractors or contractors, the Concessionaire shall be responsible for the cost of repairing said Facility and shall pay the costs therefor. During any such period where the Concessionaire repairs said Facility at its own cost under the terms of the immediately preceding sentence, the Minimum Guarantee Fee with respect to the Facility shall be payable.
Extensive Damage. 1. In the event that all or a portion of the Premises are destroyed by fire, explosion, the elements, the public enemy or other casualty, or so damaged that they are untenable and cannot reasonably be repaired within thirty (30) days, the Aviation Authority shall be under no obligation to repair, replace or reconstruct the Premises. This Minimum Annual Concession Fees and utilities charges payable by Company to the Aviation Authority hereunder shall xxxxx as of the time of such damage or destruction and shall henceforth cease until such time as said Premises are restored so as to render the Premises tenable or the Aviation Authority elects to terminate this Agreement by written notice to Company. If within twelve (12) months after the time of such damage or destruction the Aviation Authority has neither elected to terminate this Agreement, nor repaired, nor replaced, nor or reconstructed the Premises to the extent required by this Article 12, Company may terminate this Agreement by written notice to the Aviation Authority.
2. Notwithstanding the foregoing, if said Premises are destroyed or so damaged and rendered untenable so that they cannot reasonably be repaired within thirty (30) days as a result of the negligent act or omission of Company, its officers, agents, servants, employees, contractors, subcontractors, licensees, invitees, the Concession Fees payable hereunder shall not xxxxx and the Aviation Authority may, in its discretion, subject to the provisions of Article 11.C.4., above, require Company to complete repair and reconstruction of said Premises promptly and pay the costs therefor, or the Aviation Authority may repair and reconstruct said Premises, and Company shall be responsible for reimbursing the Aviation Authority for the costs and expenses incurred in such repair and reconstruction.

If the damage shall be so extensive as to render the Concession Facility unusable, but capable of being repaired in 30 days, and the Director elects to repair the Facility, the City shall proceed with due diligence to do so at its own cost and expense, and, notwithstanding Section 16.26., the fees payable herein as to such Facility shall be paid to the time of such damage and thereafter cease until such time as the Facility is fully repaired or restored; provided, however, that if the damage is caused by an act or omission of the Concessionaire, its agents, employees, suppliers, Subcontractors or contractors, the Concessionaire shall be responsible for the cost of repairing said Facility and shall pay the costs therefor.

If the damages referred to in Section 9.01 shall be so extensive as to render the Premises untenantable, the same shall be repaired with due diligence by the Contractor at its own cost and expense, subject to the limitations of Section 9.04, and a reasonable portion, as determined by the Airports Authority, of the MAG, Annual Facility Rent, and Annual Ground Rent (if applicable) under Article 5 shall xxxxx from the time of such damage until such time as the Premises are fully restored and certified by the Airports Authority as ready for occupancy; provided, however, that if said damage is caused by the act or omission of the Contractor, its sublessees, agents, or employees, the applicable MAG, Annual Facility Rent, and Annual Ground Rent, if applicable, shall not xxxxx and to the extent that such damage or destruction is not covered by insurance, the Contractor shall be responsible for reimbursing the Airports Authority for the cost and expense incurred in such repair.
Extensive Damage. If the damages referred to in Section 13.1 shall be so extensive as to render the Leased Premises untenantable, but capable of being repaired in thirty (30) days, the same shall be repaired with due diligence by City subject to the limitations of Section 13.4; and, the compensation payable herein under Section 5 shall xxxxx from the time of such damage or destruction until such time as the said Leased Premises is fully restored and certified by City's Building Inspectors as ready for occupancy; provided, however, that if said damage is caused by the negligent act or omission of Company, its sub-Lessee, agents or employees, said fees and charges will not xxxxx and, to the extent that such damage or destruction is not covered by insurance, Company shall be responsible for reimbursing City for the costs and expenses incurred in such repair.

If the damages referred to in Section 8.02 shall be so extensive as to render the Premises untenantable, but capable of being repaired in thirty (30) days, the same shall be repaired with due diligence by the Authority at its own cost and expense, subject to the limitations of Section 9.05, and an appropriate portion of the fees and concession privilege fee in the under Section 5.01 shall xxxxx from the time of such damage until such time as the Premises are fully restored and certified by the Authority's engineers as ready for occupancy; provided, however, that if said damage is caused by the act or omission of the Contractor, its sublessees, agents, or employees, the applicable rentals and fees shall not xxxxx and to the extent that such damage or destruction is not covered by insurance, the Contractor shall be responsible for reimbursing the Authority for the cost and expense incurred in such repair.
Extensive Damage. If the Rented Space is so damaged by any peril covered by the insurance to be provided by Landlord under subparagraph (a) above that rebuilding or repairs cannot in Landlord's estimation be completed within sixty (60) days after the date upon which Landlord is notified by Tenant of such damage, this Lease shall terminate, and the rent shall be abated during the unexpired portion of this Lease, effective upon the date of the occurrence of such damage.
