Common use of Damage or Theft of Personal Property Clause in Contracts

Damage or Theft of Personal Property. All personal property brought ------------------------------------ into Demised Premises by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act of co-tenants, occupants, invitees or other users of the Building or any other person, unless such theft or damage is the result of the act of Landlord or its employees and Landlord is not relieved therefrom by Article 17 hereof. Unless caused by the negligence of Landlord or its employees, Landlord shall not at any time be liable for damage to any property in or upon the Demised Premises which results from power surges or other deviations from the constancy of the electrical service or from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever.

All Subject to Landlord's maintenance of security in accordance with Building Standard Services, as set forth on Exhibit "B", all personal property brought ------------------------------------ into the Demised Premises by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act of co-tenants, occupants, invitees or other users of the Building or any other person, unless such theft or damage is the result of the act of Landlord or its employees and Landlord is not relieved therefrom by Article 17 18 hereof. All Tenant's Equipment, trade ------------------------------------ fixtures, personal property property, and other equipment brought ------------------------------------ into Demised Premises Building by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act of co-tenants, occupants, invitees or other users of the Building or any other person, unless such theft or damage is the result of the act of Landlord or its employees and Landlord is not relieved therefrom by Article 17 18 hereof. Unless caused by the negligence of Landlord or its employees, Landlord shall not at any time be liable for damage to any such property in or upon the Demised Premises Building or Project which results from power surges or other deviations from the constancy of the electrical service or from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever.

Damage or Theft of Personal Property. All As a material part of the consideration to Landlord, all personal property brought ------------------------------------ into Demised the Premises by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act or omission of co-tenants, occupants, invitees or other users of the Building or any other person, unless such theft or damage is the result of the act of Landlord or its employees and Landlord is not relieved therefrom by Article 17 hereof. Unless caused by the negligence of Landlord or its employees, Landlord shall not at any time be liable for damage to any property in or upon the Demised Premises which results from power surges or other deviations from the constancy of the electrical service or from gas, smoke, water, or rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever. Notwithstanding the foregoing, Landlord shall be liable for theft or any damage to all personal property brought into the Premises by Tenant, or Tenant's employees or business visitors if such theft thereof or any damage thereto is occasioned by the gross negligence or willful misconduct of Landlord or Landlord's agents, employees or invitees.

All Tenant’s Equipment, trade fixtures, personal property and other equipment brought ------------------------------------ into Demised Premises or onto the Project by Tenant, or Tenant's ’s subtenants and Customers and their respective employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act of co-tenants, occupants, invitees or other users of the Building or any other person, unless such theft or damage is the result of the act of Landlord or its employees and Landlord is not relieved therefrom by Article 17 hereof. Unless caused by the negligence of Landlord or its employees, Landlord shall not at any time be liable for damage to Tenant’s Equipment or any other trade fixtures, personal property or equipment in or upon the Demised Premises or at the Project, which results from power surges or other deviations from the constancy of the electrical service or from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever. Subject to Articles 18 and 37 hereof, nothing in this Article 34 shall relieve Landlord for liability for damage to property of Tenant caused by the negligence or misconduct of Landlord or Landlord’s agents and employees acting within the scope of their employment.
