Common use of Damage; Removal Clause in Contracts

Damage; Removal. Tenant shall repair all damage to the Project, the Premises and/or the Building caused by the installation or removal of Tenant’s fixtures, equipment, furniture and alterations. Landlord shall have the right upon providing Tenant with sixty (60) days prior written notice from the termination of this Lease, to require tenant to remove any or all trade fixtures, alterations, additions, improvements and partitions made or installed by Tenant after the Commencement Date and restore the Premises to its condition existing prior to the construction of any such items less normal wear and tear; provided, however, Landlord has the absolute right to require Tenant to have all or any portion of such items designated by Landlord to remain on the Premises, in which event they shall be and become the property of Landlord upon the termination of this Lease. All such removals and restoration shall be accomplished in a good and workmanlike manner and so as not to cause any damage to the Premises, the Building, the Common Area or the Project whatsoever. Landlord shall have the right upon providing Tenant with sixty forty-five (6045) days prior written notice from the termination of this Lease, to require tenant Tenant to remove any or all trade fixtures, alterations, additions, improvements and partitions made or installed by Tenant after the Commencement Date and restore the Premises to its condition existing prior to the construction of any such items less normal wear and tearitems; provided, however, Landlord has Tenant shall not have any obligation to remove the absolute right to require initial Tenant to have all or any portion of such items designated by Landlord to remain on the PremisesImprovements, as set for in which event Exhibit B. Instead they shall be and become the property of Landlord upon the termination of this Lease.
