Damages on Termination for Failure to Obtain NIGC Approval. In the event of termination of this Agreement under Section 12.2 because NIGC Approval has not been obtained on or before August 26, 2007, the Band shall be responsible for damages as provided in Section 14.4 of the Development Agreement but shall not be liable for additional damages under this Agreement.
