Data Collection and Use. Licensee agrees that it shall provide, and that mHUB may process, disclose or transfer, certain data requested by mHUB, including but not limited to operating statistics such as revenue, patents applied for and received, number of new hires, number of products sold, number of new products developed and dollars raised, as well as personal information such as the names, e-mail addresses and job titles of the Licensee's personnel.
Data Collection and Use. VENDOR will collect and use CLIENT Data only for the purpose of fulfilling its duties and providing services under this Agreement, and for improving services under this Agreement.
Data Collection and Use a) Jamf may collect and use Performance and Usage Data and Customer Content to check compliance with contractual Software usage limits; monitor the performance, integrity and stability of the Hosted Services; address or prevent technical or security issues; provide support Services; and improve the Hosted Services and/or Software. We will not otherwise access, use or process Customer Content except as necessary to provide the Services.

Licensee acknowledges and agrees that the online Products are publicly available offerings of Xxxxxxx Xxxxx’x SaaS-based subscriptions that are provided in a multi-tenant, shared database architecture, and that individualized client-dedicated infrastructure and/or processing is not part of the Product or services. Licensee understands and agrees that certain limited Licensee Data is typically required and used to enable Product and service provisioning and functionality, that such information is stored by Licensor in centrally organized data center facilities, and that certain services and functionality of the Products and associated services are provisioned through utilization of third-party provider services engaged by Licensor to deliver and support the Product and services to all of Licensor’s enterprise customers. Licensor reserves the right to collect and use information provided by Licensee and/or its Authorized End Users to process and provision the Product and associated services. Licensor reserves the right to collect and analyze data relating to use of the Product in accordance with Xxxxxxx Xxxxx’x Online Product Privacy Policy and Xxxxxxx Xxxxx’x Standard Data Processing Addendum, incorporated and made part by this reference (see below for a link to the current version of these documents). Data may be used by Rosetta Stone in anonymized or aggregate form to assess, improve and/or develop the Product and/or services, to assess compliance with the terms and conditions of this Agreement, and for other lawful purposes.

THE PRODUCT MAY INCLUDE FEATURE(S) THAT (I) GATHER PRODUCT ACTIVATION, USAGE AND/OR ENVIRONMENT INFORMATION, (II) IDENTIFY TRENDS AND/OR BUGS, (III) COLLECT USAGE STATISTICS, AND/OR (IV) TRACK OTHER DATA RELATED TO YOUR USE OF THE PRODUCT, AS FURTHER DESCRIBED IN THE CURRENT VERSION OF PROGRESS’ PRIVACY POLICY AVAILABLE AT XXXXX://XXX.XXXXXXXX.XXX/LEGAL/PRIVACY-POLICY. BY LICENSEE’S ACCEPTANCE OF THE TERMS OF THIS AGREEMENT AND/OR USE OF THE PRODUCT, LICENSEE AUTHORIZES THE COLLECTION, USE AND DISCLOSURE OF THIS DATA FOR THE PURPOSES PROVIDED FOR IN THIS AGREEMENT AND/OR THE PRIVACY POLICY. EXHIBIT A TERM OF LICENSE: Perpetual, unless otherwise specified in the applicable Order.

The Collected data does not represent personal data. Collected Data may be used by XXXXXX for purposes of providing the User with service/product recommendations, bench marking, energy monitoring, and maintenance and support. XXXXXX shall be the exclusive owner of all Collected Data.

Customer agrees that Company may collect, use, and distribute data and related information (including, but not limited to, technical information pertaining to Customer’s computers, devices, systems, software, and peripherals), for purposes of improving Company’s products, customizing services, research and analysis, promotion of the website and the Services, and other commercial purposes; provided, however, that such information will not disclose by Company in any manner that personally identifies Customer without Customer’s prior, written consent (unless required by compulsion of law). Customer agrees that Company may use information pertaining to the Customer’s business or place of employment (including, but not limited to, Customer’s business name and Customer’s business logo) for purposes of improving Company’s products, customizing services, research and analysis, promotion of the website and the Services, and other commercial purposes.
