Date of Representations Sample Clauses

Date of Representations. Except Section 3.4(f), the representations and warranties set forth in Sections 3.3 and 3.4 shall be deemed to have been made as of the date first written above. The representation and warranty set forth in Section 3.4(f) shall be deemed to have been made as of the date Schedule 1 is finalized which shall be the earlier to occur of the Construction Start Date and the Tariff Agreement Date.
