Common use of DEBT LIABILITY DISCLAIMER Clause in Contracts

DEBT LIABILITY DISCLAIMER. The STATE, including but not limited to the STATE’s General Fund or any special self-insurance programs, is not liable for any debts, liabilities, settlements, liens or any other obligations of the LESSEE or its heirs, successors or assigns. STATE, its agencies, and divisions will not be liable for and will be held harmless by LESSEE for any claims or damages associated with any contract, tort, action or inaction, error in judgment, act of negligence, intentional tort, mistakes, or other acts taken or not taken by LESSEE, its employees, agents, invitees, guests or anyone acting in concert with or on behalf of LESSEE. LESSEE shall defend the State of California and its agencies, departments and divisions from any claims, actions, lawsuits, administrative proceedings or damages associated with any contract, tort, action or inaction, error in judgment, act of negligence, intentional tort, mistakes, or other acts taken or not taken by the LESSEE, its employees, agents, invitees, guests, or anyone acting in concert with or on behalf of LESSEE.
