Deceased Class Members. If the Settlement Administrator is notified that a Participating Settlement Class Member is deceased, the Settlement Administrator is authorized to reissue the Settlement Check to the Participating Settlement Class Member’s estate upon receiving proof the Participating Settlement Class Member is deceased and after consultation with Class Counsel.
Deceased Class Members. Deceased Class Members are not eligible for rollover treatment. A Beneficiary of a deceased person who was a participant in the Plan at any time during the Class Period, including executors, heirs, assigns, estates, personal representatives, or successors-in-interest, must provide the following information with this Former Participant Claim Form to MedStar 403(b) Settlement Administrator, c/o Strategic Claims Services, 000 X Xxxxxxx Xxxxxx, Suite 205, Media PA 19063: • Death certificate and evidence that such person is authorized to receive distribution of the deceased Class Member’s settlement payment and the name and, if applicable, the percentage of distribution each person is entitled to receive; • Social Security Number of each person entitled to receive payment; • Current mailing address of each person entitled to receive payment; and • Person(s) to whom check(s) should be made payable, and amount(s) of check(s).
Deceased Class Members. 107. Claims may be submitted, along with sufficient proof of representative status, by a Legally Authorized Representative on behalf of a deceased Settlement Class Member’s estate. 108. Claims may be submitted by a Legally Authorized Representative on behalf of an incapacitated Settlement Class Member.
Deceased Class Members. If a Class Member is deceased, an authorized representative may file a Settlement Claim Form on behalf of the estate. However, the representative must provide to XXXX documentation that an estate has been established in accordance with the law and that he or she is the duly appointed representative.
Deceased Class Members. 8.2.1. If the Settlement Administrator is notified, through submission of the Estate Claim Form, a template of which is attached hereto at Exhibit I, within forty (40) days of the date of issue of a check for a Presumptive Refund Amount that a Class Member is deceased, the Settlement Administrator is authorized to reissue the check to the Class Member’s estate if it receives the following within twelve (12) months of submission of the Estate Claim Form: (a) proof of the appointment of the Personal Representative of the estate of the deceased Class Member; and (b) proof of the identity of such Personal Representative.
Deceased Class Members. If the Settlement Administrator is notified within 180 days of the date of issue of a check that a Settlement Class Member is deceased, the Settlement Administrator is authorized to reissue the Settlement Check to the Settlement Class Member’s estate upon receiving proof the Settlement Class Member is deceased and after consultation with Class Counsel and Filter Fast’s Counsel. Any replacement Settlement Checks issued to the Settlement Class Member’s estate shall remain valid and negotiable for ninety (90) days from the date of their issuance and may thereafter automatically be canceled if not cashed within that time.
Deceased Class Members. 48. Where a Class Member is deceased and a payment is due to that Class Member, the Settlement Payment may be made to such Class Member's Legally Authorized Representative or spouse or domestic partner if the Legally Authorized Representative or spouse or domestic partner is not otherwise able to cash the initial Settlement Payment.
Deceased Class Members. In the case of any deceased Class members, the estate of the deceased Class member shall be entitled to exercise all of the rights of the deceased Class member available under this settlement, including to object to the settlement, opt out of the settlement, and/or receive Settlement Benefits, and the estate of any deceased Class member covered by this settlement will be subject to the release in Section 14 of this Agreement and all other provisions of this Agreement as if the estate were a member of the Class. The person authorized to act on behalf of the estate of any deceased Class member, as provided for by probate court order or pursuant to the applicable probate procedures of the deceased Class member’s state, may contact the Settlement Administrator about any issues related to this settlement which affect the estate, and the Settlement Administrator, the Parties, and the estate shall work together in good faith to resolve any issues related to the applicability of the settlement to deceased Class members and their estates, including with respect to the reissuance of any Settlement Benefits checks. The Settlement Administrator shall require the representative of the estate of a deceased Class member to provide proof or other evidence or documentation showing that the Class member is deceased and that the representative is authorized to act on behalf of the estate of the deceased Class member.
Deceased Class Members. Where a Class Member is deceased and a payment is due to that Class Member, the 12 Settlement Payment may be made to such Class Member’s Legally Authorized Representative.
Deceased Class Members. 1. If a Class Member is, or becomes, deceased, a representative of the estate may pursue that Class Member’s claim for economic damages, but not for compensatory damages.
2. An individual seeking to pursue a claim on behalf of a deceased person must submit (i) a death certificate, and (ii) either (A) proof of current legal representation, or (B) in a situation in which a legal representative has not yet been appointed, a sworn statement describing why the submitting individual believes he or she will be appointed the legal representative of the Class Member’s estate.
3. The representative of the estate must submit a claim form with the same information as for other class members.
4. Prior to issuing a check to the representative of the estate, the Settlement Administrator must receive proof that the individual is the legal representative of the estate. The check will be issued in the name of Estate of [Class Member], not in the name of the legal representative.
