To Each Participating Class Member. An Individual Class Payment shall be paid to each Participating Class Member based on a pro rata share of the Net Settlement Amount calculated based on the number of Workweeks during the Class Period. To calculate the amount each Class Member will receive, the Net Settlement Amount will be divided by the total number of Workweeks during the Class Period to determine the base dollar amount per Workweek. The result will be multiplied by each Participating Class Member’s Workweeks to yield their Individual Class Payment.
To Each Participating Class Member. A Participating Class Member may receive an Individual Wage and Hour Class Payment, an Individual Failure to Recall Class Payment, or both.

After payment from the Gross Settlement Amount of the Class Representative Service Award, Class Counsel Fees, Class Counsel Expenses, Administrator’s Expenses, Individual PAGA Payments and LWDA PAGA Payment, the remainder of the Gross Settlement Amount (the “Net Settlement Amount”) shall be paid to the Class Members as Individual Class Payments. An Individual Class Payment 6 calculated as follows: The Net Settlement Amount will be allocated 7 among Participating Class Members on a proportional basis based on 8 the number of Work Weeks worked during the Class Period and whether 9 the Participating Class Member experienced a termination during the 10 Class Period. Participating Class Members shall be allocated one (1) 11 point of credit for each Work Week they worked within the Class Period 12 and five (5) points of credit if the Participating Class Member 13 experienced a termination between May 5, 2019 and the end of the Class 14 Period. One day worked in a given week will be credited as a Work 15 Week for purposes of these calculations. To calculate each Class 16 Member’s proportional share, the Administrator will (i) Add all points 17 for all Participating Class Members to obtain the Denominator; (ii) 18 Divide the number of points for each Participating Class Member by the 19 Denominator to obtain each Class Member’s portion of the Net 20 Settlement Amount; (iii) Multiply each Participating Class Member’s 21 portion of the Net Settlement Amount by the Net Settlement Amount to 22 determine each Class Member’s estimated individual settlement 23 payment of the Net Settlement Amount.

As defined in Section 1.45 above, a Workweek occurring between January 30, 2020 and July 31, 2020 is counted as two (2) Adjusted Workweeks. The formula set forth herein is not a material term of the Settlement and the Parties will expeditiously and in good faith agree upon an alternative formula to the extent one is required or advised by the Court to obtain Preliminary and/or Final Approval. The formula set forth herein is not, and should not be construed as, an admission of liability by Defendant, nor an admission by Defendant that any of the allegations in the Complaint and First Amended Complaint have merit.
