A written instrument intended to be executed by the Redeveloper, to be recorded in the Office of the Essex County Register of Deeds as of the date the Notice to Proceed is given to the City, and to encumber the Project Site and run with the land, setting froth certain undertakings of and restrictions applicable to the Redeveloper and its permitted successors and assigns in connection with the ownership, redevelopment or rehabilitation of the Project Site, all as more particularly described in Section 4.1 hereof, in the form attached hereto as Exhibit “A”.
