Common use of Deemed Notice Clause in Contracts

Deemed Notice. Subject to clause 33.5, a Notice given in accordance with this clause 33 is deemed to be given if: (a) personally delivered, upon delivery; (b) posted to an address in Australia, three Business Days after posting; (c) posted to an address outside Australia, 10 Business Days after posting; (d) sent by facsimile, on the next Business Day after being sent if following transmission the sender receives a transmission report indicating that the facsimile was sent to the addressee’s facsimile number; or (e) sent by email, on the next Business Day after being sent (as recorded on the device from which the sender sent the email) unless the sender receives an automated message that the email has not been delivered.

Deemed Notice. ‌ Subject to clause 33.537.5, a Notice given in accordance with this clause 33 37 is deemed to be given if: (a) personally delivered, upon delivery; (b) posted to an address in Australia, three Business Days after posting; (c) posted to an address outside Australia, 10 Business Days after posting; (d) sent by facsimile, on the next Business Day after being sent if following transmission the sender receives a transmission report indicating that the facsimile was sent to the addressee’s facsimile number; or (e) sent by email, on the next Business Day after being sent (as recorded on the device from which the sender sent the email) unless the sender receives an automated message that the email has not been delivered.
