Common use of Deemed Service Clause in Contracts

Deemed Service. (a) Subject to clause 25.2(b), a Notice will be deemed to be given as follows: (i) if by letter, when delivered personally or on actual receipt; and (ii) if by facsimile, when delivered. (b) A Notice given in accordance with clause 25.2(a) but received on a non-working day or after business hours in the place of receipt will only be deemed to be given on the next working day in that place.

Deemed Service. (a) Subject to clause 25.2(b24.2(b), a Notice will be deemed to be given as follows: (i) if by letter, when delivered personally or on actual receipt; and (ii) if by facsimile, when delivered. (b) A Notice given in accordance with clause 25.2(a24.2(a) but received on a non-working day or after business hours in the place of receipt will only be deemed to be given on the next working day in that place.

Deemed Service. Deemed Service. (b) A Notice given in accordance with sub-clause 25.2(a(a) above but received on a non-day that is not a working day or after business hours in the place of receipt will only be deemed to be given on the next working day in that place.

Deemed Service.
