Default by District. In the event of default by the District hereunder, the Developer shall have the right to pursue all legal or equitable remedies and to recover from the District all expenses incurred in pursuing its legal rights hereunder, including reasonable attorneys' fees.

Default by District. In the event of default by the District hereunder, the Developer shall shall have the right to pursue all legal or equitable remedies and to recover from the District all expenses incurred in pursuing its legal rights hereunder, including reasonable attorneys' feesfees and may be entitled to seek a writ of mandamus from a court of competent jurisdiction compelling and requiring the District and its officers to observe and perform the covenants, obligations and conditions hereof and pay amounts contemplated by this Agreement.
